Utilitarian program from Hobbes to Bentham of the design and construction of a new image of the world and of the modern State: of the origins of the inequality, of the Civil Law and of the models of the developmental states

Abstract

O artigo trata da relação entre os programas contratualista e utilitarista, no desenho e construção de uma nova imagem do mundo político e social, com fundamento no indivíduo como agente racional e autointeressado. Experimento mental, com um modelo do estado de natureza onde todos os indivíduos são iguais e livres, coloca o problema da emergência da cooperação. A solução de Hobbes é pelo Estado como agente externo, uma máquina corporativa coletiva desenhada e construída pelos indivíduos, para promover a cooperação e a igualdade de oportunidades, cuja forma é um Estado mercantilista liberal vocacionado para implantar uma sociedade industrial com base na manufatura. Bentham transforma esse modelo de Estado em um Estado do bem-estar social comprometido com o desenvolvimento de uma sociedade cada vez mais igualitária. A defesa de um sistema legal codificado, a civil law, por ambos, é central.The paper deals with the relation between the utilitarian and contractarian programs and the design and construction of a new image of the world with the basis on the individual as a rational and self-interested agent. and of the transition from the design and construction of a liberal and mercantilist State by Hobbes to an emergent design of a welfare State, with Bentham, for promoting a more equalitarian society. The thesis is that Hobbes for the first time ever establishes that the individuals are equals and free in the state of nature and that society must provide them with equal opportunity. On the other hand, Bentham defends that the individuals are unequal in the state of nature however, it is possible to design and construct, with the resources of the civil law and, particularly, of the theory of succession and inheritance, a society that promotes systematically the equality among their members
