O objetivo deste artigo é avaliar o modo pelo qual o novo governo brasileiro, ao implantar uma reforma monetária em nome do combate à hiperinflação e da reconstrução econômica, afetou a ordem constitucional em vigor desde outubro de 1988. O artigo aponta a "antinomia" entre o "público" e o "privado" na Carta de 1988, concluindo que um texto constitucional deve ser visto mais sob a óptica de sua prática histórica do que pela sua estrutura lógico-formal.The main goal of this article is to evaluate the efficacy of the Brazilian contitucional order after the "Brasil Novo" Plan, which established a new monetary order and affected many legal rights and legal guarantees. By pointing out the "antinomie" between the "public" values and the "private" ones in the Constitution of 1988, the article concludes that the Constituional text should be examined rather through its historical "practice" than through its logical formal "structure"
