These allocation processes will be pursuant to the 18 Associated Students Constitution of the campuses, as approved by the campus’s chief executive 19 officer. No impairment of existing contractual obligations shall occur in the allocation of such 20 funds. 21 B. Students enrolled in the Law School are exempted from paying the regular student activity 22 fee. Such students shall, however, pay the Law School activity fee as provided by Item 210-108, 23 April 14, 2969.”; 24   25 Whereas, Current students enrolled in the Alexander Blewett III School of Law pay a portion of the 26 Student Activity Fee, but currently receive the same services that a full fee paying student receives; 27   28 Whereas, The Parties, ASUM and SBA, seek to resolve issues related to the payment of Student Activity 29 Fees by enrolled Students at the Alexander Blewett III School of Law, and to memorialize the terms of 30 the resolution of those issues; 31   32 Whereas, ASUM Executives and SBA Executive Board members have written a Memorandum of 33 Understanding (MOU) and Board of Regents (BOR) policy change to bring to the ASUM Senate for 34 ratification;  35   36 Therefore, Let It Be Resolved, That ASUM recommends the current changes to Board of Regents Policy 37 940.3 Section 4:  38  39 “A. The budgets and funds in the possession of the associated student government associations of 40 the Montana University System, including student activity fees, shall be allocated by only the 41 officials of the respective student government. These allocation processes will be pursuant to the 42 Associated Students Constitution of the campuses, as approved by the campus’s chief executive 43 officer. No impairment of existing contractual obligations shall occur in the allocation of such 44 funds. 45 B. In recognition of the history of the Student Bar Association as a semi-autonomous student 46 organization of the Alexander Blewett III School of Law at the University of Montana, 47 students enrolled in the Alexander Blewett III School of Law shall pay the regular student 48 activity fee, with 30% of that fee allocated to the SBA and 70% allocated to the Associated 49 Students of the University of Montana”; 50   51 Therefore, Let It Be Further Resolved, That ASUM President, Alex Butler, will sign an MOU upon the 52 passage of the above Board of Regents policy reading: 53   54 “Memorandum of Understanding between 55   56 Associated Students of the University of Montana 57   58 And 59   60 Student Bar Association 61   62   63 Recitals: 64   65 Whereas, the Associated Students of the University of Montana (“ASUM”) is the recognized 66 student government organization on the University of Montana campus; 67   68 Whereas, the Student Bar Association (“SBA”) is a semi-autonomous student government 69 organization of the Alexander Blewett III School of Law at the University of Montana; 70   71 Whereas, the parties, ASUM and SBA, seek to resolve issues related to the payment of Student 72 Activity Fees by enrolled students at the Alexander Blewett III School of Law, and to memorialize 73 the terms of the resolution of those issues; 74   75 Now therefore, the parties enter into this Memorandum of Understanding (“MOU”): 76   77 I.       All enrolled students at the Alexander Blewett III School of Law will be assessed the full 78 Student Activity Fee. 79   80 A.      30% of the full Student Activity Fee paid by an enrolled student at the Alexander Blewett 81 III School of Law will be allocated to SBA. This allocation will replace the Law School Activity 82 Fee as adopted by the BOR in 1969 (see BOR Policy 940.3(4)). 83 B.      70% of the full Student Activity Fee paid by an enrolled student at the Alexander Blewett 84 III School of Law will be allocated to ASUM. 85 C.      This policy is intended to apply to any future increase or decrease of Student Activity 86 Fees approved by the BOR. 87   88 II.      In recognition of the Student Activity Fee allocation, SBA independent student 89 organizations may not be recognized as student member organizations with ASUM. 90   91 III.    All enrolled students at the Alexander Blewett III School of Law will have access to all 92 services and rights within ASUM as a full activity fee paying student except as referred to in part 93 II.   94   95 IV.     Should either ASUM or SBA wish to alter the terms of this agreement, the initiating party 96 agrees to provide the other party with 90 days’ written notice, and agrees to engage in no less 97 than three mediation sessions with an agreed-upon mediator in the 90-day period which follows 98 the initiating party’s written notice. 99   100 V.      ASUM and SBA will maintain and make available a copy of this MOU. 101   102 Effective Date: 103   104 This MOU is effective when executed by each of the following signatories. 105   106 Alex Butler, President, ASUM 107 Summer Carmack, President, SBA 108 Paul Kergis, Dean, Alexander Blewett III School of Law 109 Ona Renner-Fahey, Faculty Advisor, ASUM 110 Paul Lassiter, Vice President, Operations and Finance 111 Jon Harbor, Executive Vice President and Provost”; 112   113 Therefore, Let It Be Further Resolved, That this resolution be sent to the following: Summer Carmack, 114 President, SBA; Paul Kergis, Dean, Alexander Blewett III School of Law; Ona Renner-Fahey, Faculty 115 Advisor, ASUM; Paul Lassiter, Vice President, Operations and Finance; and Jon Harbor, Executive Vice 116 President and Provost. 117   118 Passed by ASUM Senate: __________________________, 2019 119   120   121 _______________________   122 Mariah Welch, 123 Chair of the Senate 124  125
