I MAINE STATE Lt0RAR¥02 Public MAINE E Ty DEPARTMENT OF LABOR s A F Public Sector Enforcement sectary REPORT Public Sector enforcement activity January through March 2002 • During this period, Public Sector Enforcement assessed $42,070 in penalties. • Most frequent violations: o Electrical equipment was not free from recognized hazards that are likely to cause death or serious physical harm to employees. 29CFR1910.303 (b) (1). o Employers did not have complete hazard communication program. 29CFR1910.1200(e)(1) o Fire departments did not maintain complete records of individual training for firefighters. Title 26 MRSA Ch 28 section 2102 2 (Maine law) o Employers did not have a lockout/ragout program. 29CFR1910.147(c)(1) o Portable fire extinguishers did not receive annual maintenance check. 29CFR1910.157(e)(3) Public Sector Enforcement Activities for 2001 • Public Sector Enforcement assessed $278,080 in penalties in 2001. • Primary enforcement activity in 2001 centered on fire departments, followed by water/sanitary/sewer districts, then state parks, ending with municipalities. Due to the enforcement emphasis on fire departments, the respiratory protection standard was the most cited violation. • Most frequent violations: o Employees did not receive medical evaluations before being fit-tested or using a respirator. 29CFR1910.134(e) ( 1) o Employees were not fit-tested prior to initial use of a respirator, when they use a different respirator, and at least annually thereafter. 29CFR1910.134(f) (2) o Employers did not implement and maintain the required respiratory protection program. 29CFR1910.134(c) o Employers did not have a lockout/ragout program. 29CFR1910.147(c)(l) o Portable fire extinguishers did not receive annual maintenance check. 29CFR1910.157(e)(3) Free Classes for the Public Sector •· Municipal, County, State Safety Awareness Program is an overview of public sector responsibilities, enforcement procedures and what to do when visited by a Public Sector Enforcement Officer. Spring cleaning involves a number of tasks, including sweeping left over sand and gravel by hand or power broom, chipping downed branches, cutting up downed trees, and removing other debris. All of these tasks require the use of Personal Protective Equipment (PPE). Following are brief descriptions of some of the PPE needed for outdoor clean-up: Power or hand brooms - Since sand and other road debris is dry, it is important to wear a filter face mask to reduce exposure from silica and other air borne dusts. Wear hearing protection and eye protection when using power brooms. Chain saws - Wear a hard hat with face protection, hearing protection, leather gloves, cut resistant chaps, and cut resistant boots. Chippers - Wear a hard hat with face protection, gloves, and hearing protection. When working near or on roads, always wear reflective vests and display clearly visible warning signs. The operator of any equipment should understand how the safety devices on the machine work, how to operate the machine properly, and the importance of wearing PPE. Whether on the job or at home, there is NO excuse for not wearing PPE. SafetyWorks! staff visit only at your request and cannot issue fines or citations. • Consultation - SafetyWorks! specialists can visit your workplace to identify hazards and help you control or eliminate them. • Training - The occupational safety and health specialists from SafetyWorks! can come to your workplace to train staff on a variety of workplace safety and health topics, including personal protective equipment, hazard communication, ergonomics, machine guarding, bloodborne pathogens, and many others. • Safety Committees - SafetyWorks! can help you organize a safety committee. • Noise and Air Quality Testing - Industrial hygienists can help you identify and correct problems with air quality and excessive noise. • Occupational Safety Loan Program - Through the Finance Authority of Maine, the Department of Labor offers loans of up to $50,000 at 3% interest for workplace safety improvements. To take advantage of these resources, call SafetyWorks! toll-free at 1-877-SAFE-345. The Maine Board of Occupational Safety and Health: • has adopted the 1999 OSHA regulations for general industry (29 CFR 1910) and for construction (29 CFR 1910), and • will adopt rules to strengthen protection against bloodborne pathogens. The new rules will be at least as protective as the new OSHA Directive CPL 2-2.44D, which can be found on OSHA's web page: http:llwww.osha.gov. Fire Department Inspections Many fire departments are in compliance with safety standards, but many are not. Following are violations commonly cited in fire departments. Respirators The Maine respiratory protection standard requires yearly fit-testing and periodic medical evaluations (according to age). Departments must have records of fit-testing and medical evaluation for each firefighter starting August 1, 2000, when the standard became effective. (Me 1910.134) Training Records It is the responsibility of the fire chief or his/her designee to assure that each firefighter has completed required training and that a training record is kept · for each firefighter. Before performing interior structural firefighting each firefighter must have training that meets the state firefighter standard and must have completed a controlled burn. (M.R.S.A.Ti tie 26, Chapter 28) Other common violations • Failure to document SCBA inspections • Flow test not done to manufacturers' requirements • Yearly hazardous materials awareness training not done • Yearly bloodborne pathogens training not done Many fire departments are doing an excellent job preparing and equipping firefighters for the dangerous work they do. Most of the $63,815.00 in penalties was used to correct the hazards. • Lack of respiratory protection and firefighter training and training records were the most commonly cited violations. • One willful penalty of $10,000 was assessed for lack of eye and face protection. Changes to Maine Child Labor Laws Changes to Maine child labor laws may affect public sector organizations that employ teenagers. For more information, contact the Wage and Hour Division at 624-6400. Minors Prohibited from Working at Fire Scene New child labor rules will prohibit minors under 18 years old from working at the scene of a fire, explosion or other emergency situation except as follows: Paid and volunteer junior firefighters who are 16 or 17 years old may: 1. Attend and take part in supervised training; 2. Participate in fire department functions within the rehabilitation area; 3. Pick up hose and clean up at the fire scene after the On-Scene Commander has declared the scene safe; 4. Enter a structure that has been on fire when deemed safe by the On-Scene Commander and accompanied by a firefighter; 5. With proper training, fight grass fires not involving standing timber; and 6. Perform search and rescue activities, other than structural firefighting. They may not: 1. Perform fire suppression involving structures, vehicles, or wildland fires; except grass fires not involving standing timber; 2. Operate a fire department vehicle; 3. Respond with red lights; 4. Perform firefighting "overhaul" activities; 5. Respond to hazardous material events; 6. Perform any activity, except training, that involves the use of self-contained breathing apparatus; 7. Respond to any accident involving fire or extraction activities involving motorized vehicles (referred to as "1055's"); 8. Respond to "ice rescue" activities, except within the rehabilitation area; or 9. Perform traffic control activities.
