Pod naslovom Posebnosti ustavne ureditve Bosne in Hercegovine prof. dr. Kasim Trnka, sodnik ustavnega sodišča Federacije BiH, problemsko prikazuje in kritično ocenjuje veljavno (Daytonsko) ustavno ureditev. Pravi, da gre za oktroirano ustavo. Ta ustava je sicer odločilno prispevala k vzpostavitvi in ohranjanju miru v Bosni in Hercegovini, vendar je v mnogočem zastarela in neustrezna za državo, ki se poskuša vključiti v Evropsko unijo in Nato. Po avtorjevem mnenju je v veljavni ureditvi prevelik poudarek dan konstitutivnim narodom, premajhen pa vzpostavitvi demokratičnih standardov, brez katerih je težko govoriti o sodobni demokratični evropski državi.V sklepnem delu podaja avtor omejen, po njegovem prepričanju realističen program najbolj nujnih ustavnih sprememb, ki bi lahko prispeval k vzpostavitvi Bosne in Hercegovine kot normalne evropske demokratične države. Članek objavljamo v izvirniku v bosanskem jeziku.The author gives a problem–oriented presentation and a critical evaluation of the valid (Dayton) constitutional arrangement. He claims that the constitution is obtruded. This constitution has otherwise greatly contributed to restoration and preservation of peace in Bosnia and Herzegovina, but may be in many ways outdated and unfit for a country striving to join European Union and NATO. According to the author’s belief, the current regime too much focus is placed on the constitutional nations and too little on the establishment of the democratic standard, without which it is difficult to talk about a modern democratic European state. In the final part the author gives a limited, realistic according to his beliefs, programme of urgent constitutional changes, which could contribute towards establishing Bosnia and Herzegovina as a normal European democratic state.
