Abstract
Ako je pravomoćnom presudom utvrđeno da ne postoji zahtjev na temelju kojega je ova privremena mjera dopuštena, ona prestaje pravomoćnošću te presude. Na što ne utječe ni okolnost da se između istih stranaka vodi drugi spor na temelju iste pravne osnove.If a claim secured by a temporary measure for restriction of the disposal of a vessel is rejected, the validity of such a measure will determinate when the Court decision becomes final. If the parties initiate another court action, even on the same legal ground, a new temporary measure should be sought
