Remarks on the [Croatian] Maritime Code

Abstract

Pomorski zakonik Republike Hrvatske, u odnosu na ranije propise, predstavlja nesumnjiv napredak u razvoju pomorskog prava. Neizbježno je da se u jednom tako velikom normativnom aktu nalaze rješenja s kojima se ne moraju svi slagati. Autor iznosi nekoliko napomena uz propise koji, prema njegovom mišljenju, ne predstavljaju najprikladnija rješenja. To se posebno odnosi na neke definicije Zakonika, pomorsko dobro, posebno definiciju morske obale, državnu pripadnost broda, postupak upisa u upisnik hrvatskih brodova, odgovornost brodara za smrt ili tjelesne ozljede članova posade, te prijelazne odredbe.In comparison to the previous regulations, the Croatian Maritime Code represents an improvement in development of the maritime law. Such a big normative act necessary implies solutions that are not acceptable for all. The author makes several remarks on regulations which he does not take as the most favourable solutions. The most prominent remarks are those concerning some of the Code definitions, the maritime demesne, definitions of the coast, the state to which ships belong, the entering of ships into the Croatian Register of Shiping, operator\u27s liability for death and injuries of the crew members and some of the temporary provisions
