Abstract
Autor se u radu bavi problemima unifikacije prava pomorske brodogradnje. To pravo čini ukupnost propisa koji reguliraju pravne odnose povodom gradnje, preinake i popravka brodova u pomorskim brodogradilištima.
Budući da pravo brodogradnje čine propisi iz nacionalnog zakonodavstva i međunarodnih konvencija, to autor najprije prikazuje hrvatsko pomorsko zakonodavstvo i zakonsku regulativu u najvažnijim pomorskim državama, a zatim se osvrće na one međunarodne konvencije u kojima se uređuju pojedini pravni instituti ili odnosi prava brodogradnje.
Propisi o kojima se u članku govori tiču se javnopravnih i privatnopravnih odnosa u brodogradnji, koji su regulirani ne samo u zakonima i zakonskim aktima iz nacionalnog zakonodavstva ili međunarodnih konvencija nego i u formularnom pravu koje se kreira u brodogradnji.
Na upotrebu formularnih ugovora u pomorskoj brodogradnji autor posebno ukazuje u svom referatu, sa zaključkom o potrebi unificiranja ugovora o gradnji broda kroz međunarodnu kodifikaciju putem IMO-a i CMI-a.In this paper the author deals with problems concerning the unification of the sea-shipbuilding law. This law consists of all provisions regulating legal issues connected with building, reconstruction and shiprepair in shipyards located on the sea.
Since the shipbuilding law consists of national laws and international conventions, the author begins with the analysis of the Croatian maritime law as well as the laws of the leading maritime countries. He then turns to those international conventions which deal with issues important for the shipbuilding law.
The laws and regulations dealt with in this paper involve both public law and private law aspects of shipbuilding, which are subject not only to national and international legislation, but also to the formular law in the field of shipbuilding.
The author emphasizes the need for the wide use of formular contracts in shipbuilding, as well as the necessity that the matter of shipbuilding contracts be unified by international codification through IMO and CMI
