Estado Constitucional: La protección de derechos y dificultades en su concreción

Abstract

The model of constitutional and democratic rule of law is converted into what is most advanced in matters of protection of fundamental rights for the benefit of the citizens, posterior to the model of the social rule of law, which pretended to guarantee fundamental social rights and other types of rights, [and] which hoped to gain a better quality of life for citizens in the various socioeconomic spheres, enabling the strengthening of the principles of liberty, autonomy, and material equality. These distinct state models operated in a relevant manner in the (central) states of the global North, and with precarity in the states of the South or in peripheral states. This investigation will show the characteristics of the constitutional state and the impossibility of carrying it out fully in the Latin American context in general and in the Colombian context in particular.El modelo de Estado constitucional y democrático de derecho se convierte en el más avanzado en materia de protección de derechos fundamentales para beneficio de los ciudadanos, posterior al modelo de Estado social de derecho, que pretendía garantizar los derechos sociales fundamentales y otros tipos de derechos que pretendían una mejor calidad de vida del ciudadano en las distintas esferas socioeconómicas posibilitando el fortalecimiento de los principios de libertad, autonomía e igualdad material; estos distintos modelos estatales funcionaron de una forma acertada en los contextos de los Estados del Norte global (centrales), y con situaciones precarias en los Estados del Sur o Estados periféricos. La presente investigación mostrará las características del Estado constitucional y su imposibilidad de realizarse plenamente en el contexto latinoamericano en general y colombiano en particular
