U prošlosti, sve većim razvojem pomorskog prometa, ljudi su uvidjeli potrebu za međusobnim pomaganjem na moru. To je dovelo do razvoja instituta spašavanja na moru te razvoja pomorskopravnih odredbi koje reguliraju spašavanje. Danas je pomorsko pravo spašavanja definirano Međunarodnom konvencijom o spašavanju, usvojenom 1989. godine u Londonu. Usvajanje te Konvencije, koja je zamijenila raniju iz 1910. godine, potaknuto je nezgodama tankera te potrebom za boljim stimuliranjem spašavatelje u sprječavanju onečišćenja morskog okoliša. Ovaj rad bavi se utjecajem zaštite morskog okoliša na suvremeno pravo spašavanja. Naime, Konvencijom iz 1989. godine donekle se modificiralo davno utemeljeno načelo imovinskog prava spašavanja da bez korisnog rezultata nema ni nagrade za spašavanje kako bi se potaklo spašavatelje da sudjeluju u sprječavanju onečišćenja. To je postignuto uvođenjem posebne naknade za spašavatelje koji ne ostvare pravo na klasičnu nagradu za spašavanje a sudjelovali su u spašavanju broda koji je prijetio onečišćenjem morskog okoliša.In the past, with the growth of sea transport, people have realized the need to help eachother at sea. That led to the developement of marine salvage institute and development of maritime law provisions which regulate salvage at sea. These days, the salvage law is defined by International Convention on Salvage which was adopted in 1989. in London. The adoption of that Convention, which has replaced the convention from 1910., was prompted by tanker accidents at sea and by the need of better stimulation of salvors in prevention of pollution of marine environment. This bachelor thesis is about how the contemporary salvage law is affected by marine environment protection. Namely, with the Convention from 1989. long justified principle no cure no pay of proprietary salvage law was partly modificated in order to move salvors to engage in prevention of pollution at sea.
