Abstract
The paper considers the relationships between the indigenous peoples and the Argentinian State since the XIX century until 1994, when it was introduced in the Constitution the provision acknowledging to the indigenous peoples \u201cla posesi\uf3n y propiedad comunitarias de las tierras que tradicionalmente ocupan\u201d, \u201cla entrega de otras aptas y suficientes para el desarrollo humano\u201d and granting them \u201cla parcipaci\uf3n en la gesti\uf3n referida a sus recursos naturales y a los dem\ue1s intereses que los afecten\u201d (art. 75, inc. 17). The paper describes then the issue concerning the claim for indigenous land \u2013 raised by the new constitutional provision \u2013 and focuses on some significant cases and the more recent jurisprudence on that issue
