En el escrito se destacan los costos sociales de transacción a los que está abocado
el aparato estatal en Colombia, con respecto a la legislación y programación institucional
de la restitución de tierras, en un país sin una profunda y seria reforma
agraria. La suma del conflicto armado con la desaparición de la política agraria
a la par con otros intereses, inciden para contemplar los fundamentos que deben
acompañar la iniciativa. Los costos sociales de transacción permiten establecer
las bases sobre las cuales los diferentes agentes pueden estar dispuestos a conciliar,
negociar y reparar en materia de restitución, lo que, lógicamente, implica
accesos del orden estamental, privado y social. La restitución está sujeta a la proyección
de una temporalidad que no advierte sobre las dificultades que el tema
trae; seguidamente, irrumpe en la estructura de propiedad vigente en el país y,
finalmente, no es concebido como un acervo para plantear la ineludible reforma
agraria, fundamento del conflicto.This paper expounds on the social costs of the transaction to which the country’s
State apparatus is heading for in terms of legislation and institutional planning
of land restitution, an interesting phenomenon in a country where there is no serious
or profound agrarian reform. In addition to the armed conflict, the disappearance
of agrarian policies and some other interests of the sort, have an impact on
the issues that should go along with the initiative. Social costs of this transaction
allow establishing the basis on which all the subjects must be willing to reconcile,
negotiate, and compensate damages in terms of restitution, which of course, means
access of stratified, private, and social order. Restitution is influenced by a projection
of time that does not warn about the difficulties this issue brings about; it then
storms into the country’s structure of real estate ownership in force and, lastly, it
is not conceived as heritage to finally consider the unavoidable agrarian reform,
which was the basis of the conflict
