The analysis of land acqvisition for the purpose of state roads - the cases of road sections Ivančna Gorica - Muljava and Zbilje - Vodice

Abstract

Suitable land for the purpose of construction for public benefit is not always the property owned by the state or local authority; therefore such land must be acquired. Expropriation is the utmost tool for land acquisition for public benefit and is inevitable, if the agreement with the owner of the land, marked for construction of the facilities for public benefit, cannot be achieved. In this thesis the process of land acquisition, including cadastral land arrangement, for the purpose of construction and reconstruction of the state roads is analysed. An example is made on road sections Ivančna Gorica-Muljava and Zbilje-Vodice. This thesis focuses primarily on the review of existing legislation in the field of expropriation in the Republic of Slovenia, and on the analysis of time schedules of the procedures to determine the most time-consuming tasks of the project of land acquisition and regulation for public benefit. The analysis of land acquisition procedures for both selected road sections, which was based on data provided by the Institute of spatial, municipal and residential management d.o.o., Grosuplje, has revealed certain issues in the overall procedure of land acquisition for the purpose of public benefit, especially in time-consumption of these procedures and the reasons for this long duration. As one of the result of our study we have ascertained that the land of the both studied road sections is still not completely owned by the state in spite of the process that has been lasting for several years.\ud \u
