KEDUDUKAN BANPOL SEBAGAI SATUAN POLISI PAMONG PRAJA BERDASARKAN UNDANG-UNDANG NO. 5 TAHUN 2014 TENTANG APARATUR SIPIL NEGARA DIHUBUNGKAN DENGAN PP No. 6 TAHUN 2010 TENTANG SATPOL PP

Abstract

Pada saat ini 36 ribu Bantuan Polisi Satuan Polisi Pamong Praja (Banpol Satpol PP) seluruh Indonesia masih berstatus non PNS. Mereka meminta pemerintah pusat membuat peraturan yang jelas terkait mekanisme perekrutan Satpol PP hingga menjadi PNS. Pasalnya, mereka sudah mengabdi lebih dari 10 tahun menjadi aparat negara di bidang pemerintahan daerah, Banpol Satpol PP ini akhirnya membentuk Forum Komunikasi Bantuan Polisi Satpol PP Nusantara dimana anggotanya berasal dari seluruh wilayah di Indonesia. Mereka menyatukan suara untuk menyampaikan aspirasi agar diakomodir pemerintah pusat menjadi PNS. masih ada kesenjangan sosial yang terjadi di tubuh Satpol PP, bagaimanakah kedudukan dan fungsi Banpol Satuan Polisi Pamong dan kendala apa yang dihadapi serta solusi apa yang dapat diambil oleh Banpol Satuan Polisi Pamong Praja dalam menjalankan fungsi dan tugasnya menurut Undang-Undang No. 5 Tahun 2014 tentang aparatur sipil Negara Penulisan skripsi ini bersifat deskriptif analitis dengan menggunakan metode pendekatan yuridis normatif yaitu pendekatan atau penelitian hukum yang menggunakan sumber-sumber data primer, sekunder dan tersier seperti peraturan perundang-undangan, sejarah hukum, perbandingan hukum, teori-teori hukum dan pendapat-pendapat sarjana hukum yang berhubungan. Selanjutnya dianalisis dengan metode yuridis kualitatif dalam arti bahwa data yang diperoleh dianalisis secara yuridis kualitatif dengan tidak menggunakan rumus atau data statistik melainkan hanya berupa uraian-uraian yang berisi mengenai adanya kepastian hokum Berdasarkan penelitian dapat disimpulkan bahwa Polisi Pamong Praja sebagai Perangkat wilayah menjadi Perangkat Pemerintah Daerah. Hal ini sebagaimana dijelaskan dalam Pasal 148 ayat (1) dan ayat (2) Undang – Undang 32 Tahun 2004 bahwa Kedudukan Polisi Pamong Praja sebagai Perangkat Daerah mempunyai tugas Membantu Kepala Daerah dalam memelihara Ketentraman dan Ketertiban Umum, masyarakat di daerah (cenderung tidak taat pada peraturan yang berlaku, kemampuan dan ketrampilan teknis anggota Satpol PP dalam melaksanakan operasi kurang memadai dan kurangnya kerjasama dengan instansi terkait dalam rangka penegakan Peraturan Daerah dan kurangnya peraturan yang mendasari tentang koordinasi Polisi Pamong Praja dengan instansi lainnya serta Sarana dan prasarana pendukung teknis operasional pembinaan ketentraman dan ketertiban serta penegakan Peraturan Daerah masih kurang. Then analyzed by qualitative juridical methods in the sense that the data obtained were analyzed by juridical qualitative by not using a formula or statistical data but only in the form of descriptions containing about their legal certainty Based on this study concluded that the Municipal Police as Irish territory into Irish Local Government.
