Niniejszy artykuł ma na celu wskazanie, iż dziecko to pełnoprawny podmiot w państwie prawa. Teza ta zostanie wzbogacona przez orzecznictwo sądów powszechnych, Sądu Najwyższego, a także Europejskiego Trybunału Praw Człowieka. Sytuacja prawna dziecka w Polsce jest usankcjonowana przez prawo cywilne oraz karne, a także umowy międzynarodowe, w których to Polska jest stroną. Rozważając o prawach dziecka, nie można pominąć tematu ich ochrony, a dokładniej mówiąc instytucji, które stoją na czele ich praw oraz działań organizacji pozarządowych.This article aims to indicate that a child is a fully-fledged subject in the rule of law. This thesis will be accompanied by the jurisprudence of common courts, the Supreme Court, and the European Court of Human Rights. The discussion of the legal situation of children in Poland will focus mainly on two branches of law in Poland – civil and criminal law, as well as international agreements to which Poland is a party.
