La incorporación de la participación como autor o cómplice en el homicidio doloso o su tentativa en contra del concubino del causante, como causal de indignidad en el Código Civil Peruano

Abstract

En un primer plano, la presente tesis analiza si posible o no que el precepto contenido inciso 1 del Artículo 667° del Código Civil, que sanciona con indignidad sucesoria a quienes, en calidad de autores o cómplices, atentan de manera dolosa contra la vida del causante, sus ascendientes, descendientes o cónyuge; pueda aplicarse ante al supuesto de atentado doloso contra la vida del concubino del causante. Del análisis, se advierte un vacío normativo que conlleva un riesgo de impunidad civil latente, para quienes atenten contra la vida del concubino de su causante a fin de favorecerse con ello al incrementar su porción hereditaria; sin que sea jurídicamente posible la aplicación del precepto normativo antes mencionado. Por tanto, se realiza a través de la presente tesis, una propuesta normativa que busca llenar el vacío normativo advertido, complementando así la regulación normativa vigente respecto a los derechos sucesorios reconocidos desde hace no muchos años, a los concubinos.In the foreground, this thesis analyzes whether or not it is possible that the provision contained in paragraph 1 of Article 667 of the Civil Code, which sanctions with inheritance unworthiness those who, as authors or accomplices, intentionally threaten the life of the causative, their ascendants, descendants or spouse; It can be applied in the event of a malicious attempt against the life of the deceased's concubine.
