La suspensión de la ejecución de la pena y la responsbilidad civil. El principio "alterum non laedere" y la desprotección de las víctimas y perjudicados

Abstract

The article 81.3 of the Criminal Code say that, for the approval by the judge of the suspension of the execution of the sentence of prison, “for the civil liabilities arising to have been paid, except if the Judge or Court of Law sentencing, after hearing the parties concerned and the Public Prosecutor, declares that it is fully or partially impossible for the convict to honour these”. We understand that the victims and injured parties can stay unprotected by the principle alterum non laedere, by application of that Article
