El presente artículo de investigación, abordó el tema de la reinserción social, mismo que deviene de lo normado respecto de las funciones de la pena, en cuanto que ésta cumplirá las funciones de prevención general, retribución justa, prevención especial, reinserción social y protección al condenado, a sabiendas que solo en el momento de la ejecución de la pena de prisión, operan, la prevención especial y la reinserción social. Así las cosas, en la construcción de este contenido se consideró importante investigar ¿Qué garantías se deben identificar para la reinserción social de los condenados, reclusos en el Establecimiento Penitenciario de Mediana Seguridad y Carcelario de Mocoa?, el cual se analizó desde la dimensión de la eficacia de la norma observando la operatividad de los elementos del tratamiento de reinserción social, individualización del tratamiento penitenciario y la especialización del talento humano penitenciario desarrollado por Ricardo Hernández Martínez y el incumplimiento que existe frente a la reinserción social de los condenados.
