Abstract
Se estudia la defensa judicial efectiva como figura fundamental que integra el núcleo esencial del debido proceso, determinando los derechos de cada individuo acceder a las entidades judiciales en igualdad de condiciones, a ser Juzgado por el Juez Natural y con la protección eficaz de los derechos fundamentales, presentando sus argumentos a través de una defensa judicial efectiva ejerciendo el derecho de contradicción, se evidencia como se ha regulado a través de la legislación comparada y como esta garantía en las diferentes audiencias del sistema penal acusatorio, es vulnerada y cercenada en las diferentes etapas.NingunoStudying the judicial effective defense as a mental figure that integrates the essential of due process, determining the rights of each individual to access judicial entities in equal conditions, to be judged by a natural judge and with effective protection of the fundamental rights, presenting their arguments through an effective legal defense exercising the right of contradiction, is evidence as has regulated by the comparative legislation and how this warranty in different audiences of adversarial criminal system, is violated and severed in the different stage
