Identification of policy contradictions between the resolution 365 of 2013 and the decree 2981 of 2013 under the national program for solid waste management

Abstract

El gobierno central de Colombia ha desarrollado a partir del año 1994 una normatividad aplicable al sector de servicios públicos domiciliarios, específicamente para el de aseo. Asimismo, ha desarrollado sucesivamente instrumentos jurídicos que permitan mejorar la calidad de la prestación de dicho servicio. Muestra de ello, es el avance que ha tenido este sector a partir de la Ley 142 de 1994 y que actualmente se reglamenta a través del Decreto 2981 de 2013. Sin embargo, a pesar de la iniciativa gubernamental de articular las políticas de manejo de residuos desde el orden nacional hasta los niveles distrital y municipal, la Resolución 365 de julio de 2013 cuya competencia se limita al Distrito Capital y la cual a la luz del Decreto 2981 de 2013 expedido en el mes de diciembre del mismo año por la Presidencia de la Republica, presenta algunas diferencias, las cuales se abordan en el presente artículo con la pretensión de identificar posibles modificaciones normativas que logren coherencia a la normativa actual para la eficiente prestación del servicio público domiciliario de aseo a partir del cumplimiento normativoSince 1994, the Colombian Central Government has developed applicable regulations for the utilities sector, especially for city cleaning utility. Likewise, the Government has successively developed legal instruments in order to enable the improvement of the quality in the provision of this utility. Prove of that is the progress of this sector since the promulgation of the Law 142 of 1994 which is regulated by the Decree 2981 of 2013. However, despite the Government's initiative to articulate waste management policies from National to local levels, the Resolution 365 of July 2013, whose competency is limited to the Capital District, has several differences from the Decree 2981 promulgated by the President of the Republic in December of the same year. These differences are presented and discussed in this article in order to identify possible modifications to give coherence to the existing regulations and therefore improve and make more efficient the city cleaning utility from a normative point of view
