É comummente aceite que o Judiciário comunica de forma deficiente com a sociedade, situação
potenciada pela enorme diferença dos ritmos comunicacionais (independentemente da sua
qualidade) entre o Judiciário e os meios de Comunicação Social.
A implementação da nova organização judiciária, que altera substancialmente a matriz e a estrutura
dos tribunais judiciais, veio colocar problemas novos, que acrescem aos muitos já existentes nesta
área. A concentração judiciária, independentemente dos seus méritos ou deméritos, a existência de
tribunais e das comarcas agora dimensionados à escala do distrito administrativo, e a criação de
Conselhos de Gestão com responsabilidades acrescidas pelo significativo aumento da escala
organizacional sob sua responsabilidade, vem criar a necessidade de pensar na relevância de uma
comunicação institucional para a Justiça.
Nesse pressuposto, o ponto de partida deste trabalho é a de que tem de haver um maior e mais
empenhado comprometimento com a função comunicacional por parte das instituições judiciárias
para com os cidadãos. Neste caso foi imperioso saber a opinião das principais instituições e das
entidades com responsabilidades diretas na gestão dos atuais tribunais de comarca.
O plano de investigação traçado tentou colher a opinião de três grupos distintos de entidades, mas
de importância equivalente para os objectivos traçados, com uma fase prévia de inquéritos e
entrevistas aos principais interlocutores do objecto da investigação.
O primeiro, institucional, que englobou as entidades com responsabilidades diretas na gestão do
sistema: Conselho Superior da Magistratura, Procuradoria Geral da República através do Conselho
Superior do Ministério Público, e Direção-geral da Administração da Justiça.
O segundo, igualmente institucional, visou as entidades representativas das profissões judiciárias
que são parte do sistema. Como a Associação Sindical dos Juízes, Sindicato dos Magistrados do
Ministério Público, Sindicato dos Funcionários Judiciais, Sindicato dos Oficiais de Justiça, Ordem
dos Advogados e Ordem dos Solicitadores e dos Agentes de Execução.
Um terceiro plano, institucional mas também pessoal, pretendeu recolher a opinião dos membros
dos Conselhos de Gestão das 23 Comarcas existentes: Juiz Presidente, Magistrados do Ministério
Público Coordenadores e Administradores Judiciários.
É neste esforço de reorganização judiciária, com a implementação de novas comarcas com órgãos de
gestão por objetivos, que esta nossa investigação se assume. É avaliando a complexidade inerente ao
sistema que se reflete sobre a improbabilidade, a utopia, ou se por outro lado existe potencial para
estabilizar as fronteiras e criar um sistema de auto manutenção no que respeita à comunicação desta
organização. A Justiça é sem duvida um sistema complexo a que um Plano Estratégico de
Comunicação Institucional, não pode estar alheio, proporcionando uma convivência mais
dialogante com a sociedade e salvaguardando direitos constitucionalmente protegidos considerados
prevalecentes.It is widely known and commonly accepted that the judicial system communicates poorly with the
people, mostly due to the difference of communicational rhythms (regardless of the quality of each)
between the judicial system and the media.
The implementation of a new judicial organization, with its significant changes at the level of the
courts’ organization, created a new set challenges that will, from this moment on, increase the roll
of already studied and known problems. The merge of courts and facilities, the new Judicial
Districts in pair with the Administrative Districts, and the creation of Management Councils with
new assignments over a broader number of entities, are some of the reasons to support the need of
a new institutional strategy of communication.
Taking this into account, the base line for this work is the importance of a stronger and more
efficient compromise from the judicial entities on setting a communication strategy to dialogue with
the citizens. At this level, it was crucial to meet the main opinions of the bodies dealing directly
with field managing tasks of each Court District.
Thus, the investigation plan has proposed to gather the opinion of three different but “importancelevelled”
groups of entities within each Court District, though a preliminary stage of querying and
interviewing the three major groups composing the scope of the investigation.
The first investigation group is an institutional one, consisting on the public entities with direct
management powers over the system: the high council of the Judges (Conselho Superior da Magistratura),
the General State’s Attorney (Procuradoria Geral da República) through the High
Council of the Public Prosecution Office (Conselho Superior do Ministério Público), and the
General Directorate for the Management of Justice (Direção-geral da Administração da Justiça).
The second investigation group is also an institutional one, embodied by the representatives of the
judicial professions, such as the Union Association of Judges (Associação Sindical dos Juízes), the
Union of Judges of the Public Prosecution Office (Sindicato dos Magistrados do Ministério
Público), the Union of the Judicial Employees (Sindicato dos Funcionários Judiciais), the Union of
judicial officers (Sindicato dos Oficiais de Justiça), the Bar Association (Ordem dos Advogados) and
the Chamber of Solicitors (Ordem dos Solicitadores e dos Agentes de Execução).
A third and last investigation group is both institutional with sole representative boards, counting
with the opinion of the members of the Management Boards of each one of the 23 Judicial
Districts: The Judge President (Juiz Presidente), the Public Prosecution Office’s Coordinator Judge
(Magistrado do Ministério Público Coordenador) and the judiciary Manager (Administrador
Judiciário).
It is under the effort of the recently executed judiciary reorganization, through the implementation
of new judicial districts with goal-guided governing bodies, that this research stands. It is by
analyzing the complexity of the implemented structure that it is possible to gather thoughts and
conclusions on whether the success of the maintenance of a self-managed system within the
judiciary borders is an utopia doomed to fail or not. The self-managed system has to embody a wide
inter-institutional strategy plan of communication in order to achieve a full dialogue with the
Society and to assure the protected and prevailing constitutional rights
