Analisámos a evolução dos crimes sexuais, desde a sua ligação aos crimes contra
a moral e bons costumes, até à sua qualificação como um verdadeiro crime contra as
pessoas.
Concluímos que, atualmente, a liberdade e autodeterminação sexual são os bens
jurídicos a proteger nos crimes sexuais, mas questionámos se estes bens jurídicos
coincidem com os bens jurídicos tutelados nos crimes sexuais praticados contra menores
de idade, em especial os menores de 14 anos.
Estudámos o conceito de criança, a importância dos instrumentos internacionais
para a determinação deste conceito e a criança no ordenamento jurídico interno. Assim
como a maioridade sexual e a proteção dos menores nos crimes sexuais seguindo o
critério do limite etário.
Observámos também a evolução da letra do artigo 171.º do CP – “abuso sexual de
crianças”, desde 1995 até à atualidade e a análise ao artigo atual.
Finalizamos o estudo com as críticas que surgem do artigo, tal como ele se
encontra redigido. Assim, a epígrafe e o limite etário de 14 anos. Também a aplicação da
Secção I a menores, a relevância do “consentimento” ou dissentimento do menor na
prática de atos sexuais (problema das molduras legais aplicáveis) e a remissão que é feita
para o art. 170.º do CP. A possibilidade de eliminar ou de autonomizar a Secção II para
uma maior proteção dos menores neste âmbito e, por fim, a importância do papel do
julgador quando estão em causa crimes sexuais praticados contra crianças.We have analysed the chronological evolution of sexual crimes, since its
connection to crimes against morals and good practices, to its qualification as a true crime
against individuals.
We have concluded that sexual freedom and self-determination are the legal assets
to be protected in sexual crimes, but we pose the question of realizing if this legal assets
coincide with the protected legal asset in sexual crimes perpetrated against underage
individuals, particularly those under 14 years of age.
Furthermore, we have studied the concept of "child", the importance of
international instruments to its determination and the child in the context of the internal
legal framework. As well as the age of sexual consent and the protection of minors
regarding sexual crimes, following the age limit criteria.
We have also observed the evolution of article 171 of the CP (Criminal Code) -
"sexual abuse of children", since 1995 to the present and an analysis of the current article.
We have finalised this study with the criticisms that arise from the article as it is
drafted. As such, the epigraph and the age limit of 14 years old, as well as the application
of Section I to minors, the relevance of "consent" or dissent from the minor in the practice
of sexual acts (the question of the applicable legal frameworks) and the mention to article
170 of the CP. The possibility of eliminating Section II or making it autonomous for a
larger protection of minors in this scope and, at last, the importance of the judge's part
when dealing with sexual crimes perpetrated against children
