Ambivalensi Pendekatan Yuridis Normatif dan Yuridis Sosiologis dalam Menelaah Sistem Kearifan Lokal Masyarakat Adat dalam Pengelolaan Sumber Daya Alam

Abstract

The use of normative juridical approach which is based on positivistic paradigm and socio-juridical approach which is based on constructivist paradigm in terms of a review of local knowledge systems of indigenous peoples in the management of natural resources tend to be separated. This trend has implications for the emergence of ambivalence in attitude research approaches among researchers both from academia law and law students. It required a modeling approach that is able to elaborate and integrate both approaches to address research problems
