Alexis Mourre, President of the ICCCourt made an opening speech on the importance of usingICT in the future dispute resolution. The conference wasdivided into several sections including ODR in con ict zones,online court, corporate in-house ODR, consumer ODR,technology used by dispute resolution organizations, ethicsand standards of ODR,  AI and data protection, ODR serviceproviders, and  nally the challenge of ODR.Various forms of ODRFrom the successful story of eBay in dealing with theirconsumer disputes by using the in-house online mediation,ODR has started to gain the attention of both researchersand entrepreneurs to establish the ODR world. ODR isintended to be used as an e cient dispute resolution whichintegrates information technology to settle out-of-courtdisputes. Nowadays, the scope of ODR has been stretchedto anything that is related to dispute resolution andtechnology.ODR has also been used in international public law toreconcile con icts of wars, refugees and protection ofweaker parties such as women and the poor. FrançoisZimerary, former French ambassador for Human Rights hascon rmed the role of ODR in facilitating interlocutionbetween con icted parties in human rights protection.Sanjana Hattotuwa has illustrated how ICT can be used inpeacebuilding, con ict transformation and crisis response.Online court has become a trend in ODR as well. Last year,the topic of ODR conference in Hague was focused on therole of ODR to help court and access to justice. In Englandand Wales, Lord Justice Briggs Report has shown theimportance to develop the online court to enable civildisputes of modest value and complexity to be justlyresolved without incurring the disproportionate cost of legalrepresentation.[1] The Council of Europe has alsocon rmed the  role of ODR in improving parties’ access tojustice.[2] From the panel discussion, at the current stage,the information technology is helpful in shortening time ofproceedings via electronic  ling and digital casemanagement.We have also heard speakers from traditional disputeresolution organizations to illustrate how they handle casesonline. ICC is upgrading their Netcase case managementsystem to better serve the document exchangerequirement during arbitration proceedings. ShenzhenArbitration Commission from China has developed anonline arbitration platform to online arbitration togetherwith electronic evidence preservation services. We have also been informed about how AI helps topredict justice and to analyze data collected from arbitralinstitutions and arbitrators to allow parties have betterunderstanding of arbitration and select arbitrators.The discussion from the debate between automation andhuman beings turned out that, at the current stage, AI is stillused to facilitate dispute resolution that involves humanbeings. Perhaps machine learning and algorithms will makeautomated dispute resolution possible in the future.However taking into regard that dispute resolution is acomplex process consisting of various factors (law,psychology, society, etc.), automated dispute resolution willnot be a wonder drug for all.Challenges and regulation of ODRWhile it is exciting hear new developments in the ODRindustry, I started to wonder whether ODR is packed withtoo many elements and it becomes harder to understandwhat is ODR and who it serves to.Scholars such as Daniel Rainey, Leah Wing, Carre Menkel-Meadow and Nancy Welsh have worked on ethics andstandards to regulate ODR. But, as Brian Hutchinsonpointed out at the conference, we need to know who shouldmake these ODR ethics and standards, whom should ODRethics and standards be applied to and who will enforcethem in order to ensure justice in ODR and enhance trust inusing ODR.While celebrating the successful development, we should becautious in what circumstances can ODR be used andcontrol the quality of these ODR services.
