El Título VII del Proyecto de Ley Orgánica para la igualdad efectiva de mujeres y hombres
prevé la realización voluntaria de acciones de responsabilidad social por las empresas en
materia de igualdad, acciones que pueden ser también objeto de concertación con los agentes
sociales. Específicamente, se regula el uso de estas acciones con fines publicitarios y el
fomento de la presencia equilibrada de mujeres y hombres en los consejos de administraci
ón de las sociedades mercantiles.
La Responsabilidad Social surge con carácter voluntario, no exigible coactivamente, por lo
que los antecedentes de las normas objeto de análisis no se suelen encontrar en instrumentos
normativos, sino en documentos de fomento. Sin embargo, en algunos casos, tales
normas éticas se «juridifican», al incorporarse a textos legales.
Tras un repaso a las propuestas que a nivel internacional y europeo inciden en una perspectiva
de género para las políticas de responsabilidad social, concluimos que las medidas
que propone el Proyecto de Ley Orgánica son jurídicamente aceptables.Title VII of the Spanish Organic Law for the Effective Equality of Women and Men
contemplates the companies’ voluntary application of social responsibility actions
regarding equality, actions that may be agreed upon together with the social
agents. Specifically, the regulations include the use of these actions for publicity
purposes and the promotion of a balanced participation of both men and women in
the management board of companies. Social Responsibility is understood in
voluntary terms, and therefore cannot be demanded coercively, hence the origins
of these norms being found in promotion tools, not in normative, legislative
instruments. Still, in a number of cases the said ethical guidelines are “juridified”
when incorporated to legal texts. After a revision of the different contributions at
international and European level on gender perspective in social responsibility
policies we conclude that the measures included in the Organic Law project are
legally acceptable
