Dinï€ªï€ªImam Jauhariï€ªï€ªï€ªABSTRACT In Islamic criminal law very closely related, that sanction in Islam that pornography is not yet clear the certainty of punishment fora criminal offence of pornography, since the Qur'an is not described directly the punishment of the perpetrators of criminal acts ofpornography, just just explained the prohibition to approach the adultery, so Islam explained that the penalties for the perpetratorsof the crime of pornography can be punished with the punishment of adultery, ta'zir, qisas and so on. Even the law is taken throughnothing by taking the laws that already exist such as punishment of the perpetrator of pornography are regulated in Act No. 44 ofthe year 2008 about pornography and diserah to the Ulil Amri (Government). Research is a major problem (1) how form and criteriaof crime of pornography in positive law and criminal law of Islam? (2) how is pornography a criminal offence sanctions accordingto Act No. 44 of the year 2008 and the Islamic criminal law? (3) how is the impact of the criminal offence of pornography?Research and study aims, to find and develop theories about the concept of Islamic law in the pornography and the crime theory,theory of Criminal Law, and the theory of criminal law policy.The research method used is the juridical normative legal research methods, methods of historical and comparative methods. Withthe date source is secondary legal materials in the form of primary, secondary legal materials and legal materials tertiary(supporting). Date obtained, either from primary law, secondary, tertiary, as well as information from experts, then the date analysiswas done with a descriptive qualitative approach, namely the analysis of the contents.The results of this study suggest that first, the forms and criteria in the Islamic criminal law can be categorized as a criminal offenceof pornography the existence of forms of behaviour, against the law of nature, errors, due to the accompanying circumstances,constitutive, terms In addition to possible criminal prosecuted, and additional terms to be criminal. Secondly, sanctions the crime ofpornography according to Act No. 44 of the year 2008 and the Islamic criminal law, most short imprisonment 6 (six) months, andthe longest 12 (twelve) years, and/or Criminal fines of at least Rp. 250 million,-(two hundred and fifty million rupiah), and at most6 billion rupiah (six billion dollars). While in Islamic law the penalty for the perpetrator of a criminal offence of pornography canbe punished with the punishment of adultery, ta'zir, qisas and so on. Third, the impact of the criminal offence of pornography thatthe criminal offence of pornography can trigger occurs and the expansion of the criminal act of decency such as rape, indecentdeeds a.It is recommended that the Government should be more serious in jellies toward pornography a criminal offence because the deedrefers to norms of decency, for that Government and the MUI must be assertive in taking decisions to determine the sentenceagainst the perpetrator of the criminal offence of pornography. Din Imam Jauhari ABSTRAKDalam hukum pidana Islam sangat berkaitan erat, bahwa sanksi pornografi dalam Islam itu belum jelas kepastian hukuman bagitindak pidana pornografi, karena dalam Al-Qurâ€™an tidak dijelaskan secara langsung hukuman bagi pelaku tindak pidanapornografi, hanya saja dijelaskan larangan untuk mendekati zina, jadi dalam Islam menjelaskan bahwa hukuman bagi pelaku tindakpidana pornografi itu bisa dihukum dengan hukuman zina, taâ€™zir, qisas dan sebagainya. Bahkan hukumnya diambil melaluiqiyas dengan mengambil hukum-hukum yang sudah ada seperti hukuman pelaku tindak pornografi yang diatur dalamUndang-Undang Nomor 44 Tahun 2008 tentang Pornografi dan diserah kepada Ulil Amri (Pemerintah) tersebut. Masalah pokokpenelitian ialah (1) Bagaimanakah bentuk dan kriteria tindak pidana pornografi dalam Hukum Positif dan Hukum Pidana Islam? (2)Bagaimanakah sanksi tindak pidana pornografi menurut Undang-Undang Nomor 44 Tahun 2008 dan Hukum Pidana Islam? (3)Bagaimanakah dampak tindak pidana pornografi? Penelitian dan pengkajian ini bertujuan, menemukan dan mengembangkan teori mengenai konsep hukum Islam dalam pornografiserta teori tindak pidana, teori pemidanaan, dan teori kebijakan hukum pidana,	Metode Penelitian yang digunakan adalah metode penelitian hukum yuridis normatif, metode sejarah dan metode perbandingan.Dengan sumber data adalah sekunder yang berupa bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier(penunjang). Data yang diperoleh, baik dari bahan hukum primer, sekunder, tersier, serta informasi dari para ahli, maka analisis datadilakukan dengan pendekatan deskriptif kualitatif yaitu analisis isi. 	Hasil penelitian ini menunjukan bahwa pertama, bentuk dan kriteria dalam hukum pidana Islam yang dapat dikategorikan sebagaitindak pidana pornografi adanya bentuk tingkah laku, sifat melawan hukum, kesalahan, akibat konstitutif, keadaan menyertai, syarattambahan untuk dapatnya dituntut pidana, dan syarat tambahan untuk dapat di pidana. Kedua, sanksi tindak pidana pornografimenurut Undang-Undang Nomor 44 Tahun 2008 dan Hukum Pidana Islam, Pidana penjara paling singkat 6 (enam) bulan, danPaling lama 12 (dua belas) tahun, dan/atau Pidana denda paling sedikit Rp. 250.000.000,- (dua ratus lima puluh juta rupiah), danPaling banyak Rp. 6.000.000.000,- (enam miliar rupiah). Sedangkan dalam Hukum Islam hukuman bagi pelaku tindak pidanapornografi itu bisa dihukum dengan hukuman zina, taâ€™zir, qisas dan sebagainya. Ketiga, Dampak Tindak Pidana Pornografibahwa tindak pidana pornografi dapat memicu terjadi dan berkembangnya tindak pidana kesusilaan lainnya seperti perkosaan,perbuatan cabul atau perzinahan, sebab pikiran dan nafsu seksualias seseorang sangat terpengaruh akibat pornografi dan mendorongagresifitas seseorang untuk melakukan berbagai tindak pidana kesusilaan. Upaya penanggulangan tindak pidana kesusilaan akibatpornografi dapat dilakukan secara preventif yang harus melibatkan aparat penegak hukum, khususnya kepolisian, pemerintah,masyarakat juga keluarga. Selain itu sebagai jalan terakhir dapat ditempuh jalur hukum untuk mempertanggung jawabkan perbuatanpelaku.	Disarankan agar Pemerintah harus lebih serius dalam jeli terhadap tindak pidana pornografi karena perbuatan tersebut mengacupada norma-norma kesusilaan, untuk itu pemerintah dan MUI harus tegas dalam mengambil keputusan untuk menentukan hukumanterhadap pelaku tindak pidana pornografi. Serta membatasi bentuk dan kriteria dalam peredaran pornografi dengan perbaikanmengenai kategori pornografi dalam suatu peraturan perundang-undangan dan hukum pidana Islam, dengan menambahkan sanksiyang dikenakan yang harus lebih berat dari sebelumnya. Hendaknya sanksi tindak pidana pornografi menurut Undang-UndangNomor 44 Tahun 2008 dalam Hukum Positif dan Hukum Islam serta harapan kedepannya dapat dipertegas lagi supaya para aparatpenegak hukum dapat menjalankan fungsinya dengan maksimal dalam upaya-upaya pemberantasan tindak pidana pornografi yangdewasa ini semakin memprihatinkan. Hendaknya dampak tindakan pornografi dalam bentuk apapun. Karena tindak pornografidapat membawa seseorang kepada perbuatan zina yang dihendaki Allah.
