Exclude and punish opponents in the Revolution. Notes about the “juicio de residencia” ordered by the “Asamblea del año XIII”

Abstract

Este artículo se propone tomar el juicio de residencia establecido por la Asamblea General Constituyente como un procedimiento que encarna, más allá de su especificidad jurídica, una forma política. En tanto juzgar implica examinar una conducta o acción, constituye una operación que forma parte de una actividad de control, pero también de una puesta a prueba de los valores y normas de una comunidad. De este modo, la residencia traspasa el marco estrictamente judicial para cumplir un rol determinado en las disputas políticas, operando como mecanismo de justificación del desplazamiento de los opositores e instituyendo a la vez, cierta visión sobre el quehacer político. El análisis del proceso judicial se plantea en dos niveles; en el primero, se aborda el campo jurídico para examinar el tipo de juicio al que fueron sometidos los imputados, y en el segundo se trabaja sobre el conjunto de ideas y valores que rodearon la “conducta pública” de los residenciados.This article proposes to take the "juicio de residencia" ordered by the Asamblea General Constituyente as a procedure that embodies beyond legal specificity, a political form. To judge involves examining a behavior or action; therefore, it is an operation that is part of a control mechanism, but also a testing of the values and rules of a community. Thus, the "residencia" transcends the strictly judicial framework and fulfills a specific role in political disputes, operating as a justifying mechanism of the opponents’ displacement, and establishing a certain vision about political routine. The analysis of the judicial process involves two levels. In the first one, the legal field is taken to examine the trial that the accused were subjected.
