Os direitos humanos constituem um dos debates candentes da atualidade. A afirmação
de direitos inalienáveis, assentes no princípio da dignidade da pessoa humana, e
atribuídos a todos os seres humanos, tornou-se um dos principais desígnios do Estado
de direito, que, pelo estabelecimento e garantia de direitos fundamentais, visa a proteção
e a promoção, também em concertação alargada com a Comunidade Internacional, de
condições de justiça, paz, igualdade e liberdade para todos os indivíduos no conjunto
alargado da humanidade. Não obstante, estes mesmos direitos representam um desafio
permanente para os seus defensores, pelas dificuldades práticas de efetividade nos
horizontes particulares e globais de aplicabilidade que simultaneamente demandam.
Tomando por base a elaboração e a afirmação dos direitos humanos no quadro
da longa duração, com particular incidência a partir do contexto revolucionário de
proclamação dos direitos do homem e do cidadão na segunda metade do séc. XVIII
(mas, subsidiariamente, não descurando precursoras elaborações de um desígnio
humanizante e dignificante no âmbito da história das ideias e dos conceitos), a presente
dissertação visa identificar, tematizar e problematizar os discursos e as práticas de
consciencialização e de expressão destes proclamados direitos em Portugal, nos sécs.
XVIII e XIX, com especial atenção para o período compreendido entre 1755 e 1867.
Neste sentido, com base num corpus alargado e representativo, parte-se da
hipótese de que é possível perscrutar uma gradual elaboração dos direitos do homem
nos espíritos e nos discursos no quadro da cultura portuguesa, bem como confirmar a
sua consagração na lei, sob a forma de direitos individuais, a partir do movimento
constitucional iniciado em 1820, inaugurador de uma era dos direitos, por oposição ao
paradigma anterior de Antigo Regime, com especial incidência em deveres decorrentes
da aliança entre Trono e Altar. Ao longo deste percurso, considerar-se-á, no entanto, de
igual modo imperativo dar conta das dissensões entre as teorias e as práticas, em
avanços e recuos, entre o desígnio, que pode ser interpretado como utópico, de
afirmação desses direitos e a efetiva garantia legal dos mesmos. Complementarmente
identificar-se-ão algumas das leis e medidas consideradas pioneiras para esta afirmação
dos direitos humanos em Portugal e, dialeticamente, intentar-se-á uma problematização
e apreciação crítica da sua efetiva aplicação no plano das práticas, atendendo
necessariamente também ao seu lugar e valor no plano internacional.Human rights are one of today’s most pressing debates. The affirmation of inalienable
rights, based on the principle of human dignity, and attributed to all human beings, has
become one of the main purposes of the rule of law, which, by establishing and
guaranteeing fundamental rights, aims at protecting and promoting, also in broad
discussion with the International Community, conditions of justice, peace, equality and
freedom for all individuals in the broader canvas of humanity. Despite this, these same
rights are a permanent challenge for their defenders, due to the practical difficulties of
effectiveness in the particular and global horizons of applicability that they
simultaneously require.
Considering the elaboration and affirmation of human rights in a long term
perspective, with particular focus from the revolutionary context of the Declaration of
the Rights of Man and of the Citizen in the second half of the 18th century (but also not
neglecting precursors to a humanizing and dignifying ideal in the context of the history
of ideas and concepts), this dissertation aims to identify, thematize and problematize the
discourses and practices of awareness and expression of these proclaimed rights in
Portugal, during the 18th and 19th centuries, with special dedication to the period
between 1755 and 1867.
In this sense, using a broad and representative corpus, we start from the
hypothesis that it is possible to examine a gradual elaboration of human rights in the
minds and discourses in the context of Portuguese culture, as well as to confirm their
legal enshrinement, under the form of individual rights, starting with the constitutional
movement initiated in 1820, which inaugurated an era of rights, in opposition to the
previous paradigm of the Old Regime, with special emphasis on duties arising from the
pact between the Throne and the Altar. Along this path, however, we will also equally
consider the difference between theory and practice, between the advances and
setbacks, between the ideal, which could be seen as utopian, of affirming these rights
and their actual legal safeguard. Additionally, we will identify some of the laws and
remedies seen as pioneer for the affirmation of human rights in Portugal and,
dialectically, we will also attempt to problematize and critically assess their effective
application in terms of practices, also considering their place and value at the
international level
