Relatório apresentado à Universidade Fernando Pessoa como parte dos requisitos para o cumprimento do programa de Pós-Doutoramento em Ciências Humanas e SociaisO estudo problematiza a garantia do direito à educação, colocando sob análise
os limites e as possibilidades dessa efetivação, nos contextos contemporâneos,
e mais especificamente no contexto das crises humanitárias. Na discussão a
argumentação está reunida em três capítulos. Inicialmente, são apresentados os
limites que se manifestam nas violências advindas dos âmbitos econômico e
político, identificados nas faces da desigualdade e da exclusão social. A
identificação dos aspectos limitadores está referida em relatórios do UNICEF
(2005, 2016) e da ONU (2018), além dos estudos de Milanovic (2017), Stiglitz
(2018), Sarmento (2010), Bastos et al. (2008, 2011), Bastos e Veiga (2016),
Moura (2010), Cardona et al. (2008), Morin (2007), bem como nos fatores de
riscos extraídos da percepção de participantes de um estudo empírico. As
possibilidades para a garantia dos direitos da criança estão na constituição de
recursos de proteção para as crianças e adolescentes, tendo como ênfase a
garantia dos direitos à educação. A discussão se sustenta nas garantias
propostas nas políticas de Direitos Humanos e do Direito Internacional
Humanitário, nos fatores de proteção identificados em pesquisa empírica sobre
os cotidianos infantis, nos estudos de Deyra (2001), Cardona et al. (2008), e
Fernandes (2009). Foram também tomados em conta os requisitos mínimos para
a educação em situação de emergência (INEE, 2006). Os argumentos que
sustentam o estudo têm em consideração a necessária recontextualização e
ressignificação dos conceitos, num cenário de transições paradigmáticas
(Santos, 2007) que caracterizam o contexto contemporâneo, produzindo um
alargamento interpretativo sobre as categorias em estudo. Assim, o estudo
assume como tese a necessidade da garantia do direito à educação de crianças
e adolescentes na perspectiva de um currículo intercultural, como possibilidade
de superação das violências que incidem sobre a infância em situação
humanitária na contemporaneidade. Nessa direção, se apresenta a
argumentação quanto a garantia do direito à educação, num currículo
intercultural contemplando: 1) O direito à participação como recurso
emancipatório; 2) O direito à diferença como recurso identitário; 3) O currículo
intercultural na garantia do direito à educação; com referência em Vieira (2017),
Sarmento (2015), Torres (2013), Silva (2013) e Santos (2010). O estudo permite constatar o quanto as populações infantis e o mundo como um todo, vive os
danos colaterais das sociedades desiguais e excludentes, sendo a pobreza um
dos maiores fatores de violências nos seus cotidianos. Entretanto, essas
violências atingem uma escala tal, nos contextos atuais, que colocam as crianças
em situação humanitária. Nesses territórios, a educação precisa atuar como fator
de proteção por excelência. Assim, todos os esforços merecem ser envidados
para sua garantia. Isso, tendo como pressuposto que na efetivação da garantia
do direito à educação, a interculturalidade tem centralidade. Portanto, a
interculturalidade no currículo se constitui ao mesmo tempo em conteúdo,
método e indicador da efetivação do direito à educação capaz de superar as
violências da desigualdade e da exclusão que se produzem e reproduzem em
discursos que se valem da distorção de argumentos culturais para as justificar.The study problematizes the guarantee of the right to education, putting under
review the limits and possibilities of this effect, in contemporary contexts, and
more specifically in the context of the humanitarian crisis. In the discussion the
argument is gathered in three chapters, initially are presented the limits that
manifest in the violences coming from the economic and political scopes,
identified in the faces of inequality and social exclusion.The identification of the
limiting aspects is countersigned in reports from UNICEF (2005, 2016) and from
UN (2018), in addition to studies by Milanovic (2017) and Stiglitz (2018),
Sarmento (2010), Bastos et al. (2008, 2011), Bastos and Veiga (2016), Moura
(2010), Cardona et al. (2008), Morin (2007). Also, in the risk factors extracted
from participants' perception of an empirical study. The possibilities for the
guarantee of childhood rights are in the constitution of protection resources for
children and adolescents, emphasizing the guarantee of the rights to education.
The discussion is based on the guarantees proposed in human rights policies
and international humanitarian rights, and in the protection factors identified in
empirical research on children's daily life, and in the studies of Deyra (2001),
Cardona et al. (2008), Fernandes (2009). Also taken into account the minimum
requirements for emergency education (INEE, 2006). The arguments that
endorse the study, take into account the necessary recontextualization and
remeaning of the concepts, in a scenario of transitions paradigmatic (Santos,
2007) that characterize the contemporary context, producing an enlargement
Interpretive on the categories under study. Thus, the thesis advocated in this
study presupposes the need the need to guarantee the right to education of
children and adolescents in the perspective of an intercultural curriculum, as the
possibility of overcoming the violence that focuses on childhood in a humanitarian
situation in Contemporaneity. In this direction, the argument is presented as to
the guarantee of the right to education, in an intercultural curriculum
contemplating: 1) the right to participation as an emancipatory resource; 2) The
right to the difference as a identity resource; 3) The intercultural curriculum in the
guarantee of the right to education; with reference in Vieira (2017), Sarmento
(2015), Torres (2013), Silva (2013) and Santos (2010).The study allows us to see
how much the child populations and the world as a whole live the collateral
damage of unequal and exclusionary societies, with poverty being one of the
biggest factors of violence in their daily lives. However, these violences reach
such a scale in the current contexts that place the children in a humanitarian
situation. In these territories, education needs to act as a factor of protection par excellence. So all efforts deserve to be made for their guarantee. And, on the
assumption that in the effective guarantee of the right to education, Interculturality
has centrality. Therefore, the interculturality in the curriculum, is at the same time
in content, method and indicator of the effectiveness of the right to education able
to overcome the violences of inequality and exclusion that are produced and
reproduced in speeches that are worth the distortion of cultural arguments to
justify them.N/
