Frente al surgimiento de un abundante derecho especial resulta necesario plantearse si las normas generales del derecho civil son las que deben aplicarse para aquellas situaciones que no estén especialmente regidas por una regla diferente, en circunstancias que el vínculo derecho general/ especial perece no existir debido a que las normas especiales han logrado provocar la emersión de una nueva lógica en un sector normativo determinado.The rise of an abundant Special Law necessarily raises the question as to whether the general regulations of Civil Law should be applied in situations which are not governed especially by a different rule, in circumstances in which the link between general and special law appears not to exist because the special regulations have caused a new logic to emerge in a determined regulatory sector
