The Formal Conditions of some Objective Dismissals

Abstract

[Resumo] A idea do artigo é extraer as condicións formais que se impoñen actualmente para que un despedimento obxectivo, baseado en causas económicas, técnicas, organizativas ou de produción, sexa declarado procedente: desde a comunicación por escrito até a posta a disposición da indemnización, pasando polo aviso previo e, sobre todo, pola esixencia da notificación aos representantes dos traballadores [esixencia «creada» polo Tribunal Supremo en función dunha interpretación do artigo 53.1.c) do Estatuto dos traballadores].[Abstract] The idea of this paper is to extract what are the formal conditions currently imposed for an objective dismissal, based on causes economic, technical, organizational or production, being declared just cause: the notice, the communication in writing, the availability of the compensation as well as the requirement of notification to the workers’ representatives [requirement “created” by the Supreme Court on the basis of an interpretation about article 53.1.c) of Workers’ Statute]
