[Resumen] Estudio del contenido del derecho fundamental de igualdad en su dimensión formal
y material. Análisis de la respuesta doctrinal y jurisprudencial a los problemas que
plantea el concepto de igualdad ante la ley y la igualdad en la aplicación de la ley. La
cuestión de las acciones positivas o discriminación inversa como cauce para promover
la igualdad real. Análisis del proyecto de ley de igualdad y de sus medidas de garantía
y promoción de la igualdad real entre hombres y mujeres.[Abstract] To study the legal content of the fundamental right to equal treatment in two
different perspectives: formal equality and real equal treatment. To analyses the scholars
opinions and the tribunal’s answers to the problems related with the right to equality
before and under the law. The question of the positive actions, or differential treatment,
as a source to reach real equality. To analyse the Spanish project of law to promote
the right to equality, its guarantee and enforcement of the equal treatment among
men and women
