Las tasas judiciales (o sobre la aflicción) desde la perspectiva constitucional

Abstract

El presente trabajo tiene por objeto realizar un esbozo de las claves que permiten confrontar con la Constitución las tasas judiciales establecidas por la Ley 10/2012, de 20 de noviembre, así como su modifi cación por el Real Decreto Ley 3/2013 de 22 de febrero. Aunque en principio la Constitución no se opone al establecimiento de un sistema de tasas judiciales, el legislador ha de respetar los límites que se derivan de la Constitución y especialmente de lo dispuesto en sus arts. 24.1 y 119.1This article aims at examining from a constitutional point of view the court fee regulation brought in with the recent Law 10/2012 of 20 November as amended by Royal Law Decree 3/2013 of 13 February.
