NO 3 (1980) désignation des employés dits «essentiels» ou la procédure de griefs de même qu'une brève discussion du rapport du Comité Finkelman, créé par le gouvernement fédéral en 1963 dans le but de voir à l'opportunité d'apporter des révisions à la loi. À cause de l'époque où fut réalisée cette recherche, l'auteur n'a pu traiter des amende-ments qui ont été apportés à la loi, à la suite du rapport Finkelman, et qui ont grandement irrité l'Alliance. Les chapitres 4 et 5 sont consacrés res-pectivement aux origines et à l'organisation interne de l'Alliance. Il est intéressant de constater que les fonctionnaires fédéraux, qui s'étaient toujours regroupés dans une multi-tude d'associations rivales, se sont vus plus ou moins forcés de se réunir dans une grande association — l'Alliance de la fonction publi-que du Canada — en 1966, parce qu'une lé-gislation autorisant la négociation collective était sur le point d'être adoptée. D'ailleurs, l'évolution de presque toutes les associations de fonctionnaires avait toujours été influen-cée par les diverses législations adoptées anté-rieurement dans la fonction publique fédéra-le. Le chapitre 6 est consacré à décrire le ty-pe de relations qu'entretient l'Alliance avec le gouvernement. La méthode utilisée est em-pruntée au modèle utilisé par Harbison et Coleman dans leur volume Goals and Strate-gy in Collective Bargaining (1951) où les au-teurs identifient trois grands types de rela-tions possibles: la trêve armée, l'harmonie conflictuelle et la coopération. Maurice Lemelin applique ce cadre d'analyse à des su-jets relatifs à la convention collective tels le statut des parties, le contrôle des emplois (dont le terme «sécurité d'emploi» est mieux adapté au secteur public), les griefs, les com-munications entre les parties et des questions économiques. En conclusion, l'auteur affir-me que le type «harmonie conflictuelle» sem-ble le plus apte à décrire les relations entre le gouvernement et l'Alliance. Le dernier chapitre traite des relations de l'Alliance avec le Congrès du travail du Canada et avec le syndicat canadien de la fonction publique. On y discute de l'épineuse question de l'affiliation des fonctionnaires provinciaux qui se faisait directement au CTC sans passer par une union nationale ain-si que des prétentions du SCFP à représenter ces syndiqués selon les statuts mêmes du CTC. L'auteur aborde également le congrès assez houleux du CTC tenu à Vancouver en 1974 où une coalition de délégués de l'Allian-ce du SCFP et de la Fédération des travail-leurs du Québec réussirent à faire adopter des résolutions donnant de plus grands pouvoirs à la FTQ à l'intérieur du CTC et imposant des normes d'autonomie plus strictes pour les lo-caux canadiens d'unions internationales. Sur cette dernière question cependant, l'auteur se trompe en affirmant que les délégués ont ac-cepté la résolution permettant à des locaux canadiens de se fusionner avec ceux d'autres unions sans attendre que la fusion des organi-sations internationales ait été réalisée. Les délégués ont plutôt adopté une résolution de compromis qui excluait ce sujet. Dans l'ensemble, l'ouvrage de Maurice Lemelin apporte une excellente contribution à la compréhension du fonctionnement de l'un des plus gros syndicats canadiens et des relations que ce syndicat entretient avec le plus important employeur du Canada: le gou-vernement fédéral. En guise de critique, on peut déplorer qu'étant donné que la recher-che avait d'abord été conçue pour un public américain, l'auteur doive expliquer des réali-tés déjà bien connues par un auditoire cana-dien comme ce que sont la CSN, la FTQ, le CTC. Enfin, le principal reproche qu'il faut adresser à ce livre, et qui est indépendant de la volonté de l'auteur, est qu'il a été écrit trop tôt. En effet, de récents développements sur-venus dans la législation sur les relations de travail dans la fonction publique fédérale ont entraîné une assez forte radicalisation des ac-tions de ce syndicat et le livre ne peut malheu-reusement pas en analyser les implications ni Université Laval Public Access: Citizens and Collective Bar-gaining in the Public Schools, edited by RECENSIONS - BOOK REVIEWS 609 Robert E. Doherty, Ithaca, New York, ILR Publications, New York State School of Industrial and Labor Rela-tions, 1979, 100 pp. In 1978 a group of prominent teacher or-ganization leaders, labor relation specialists, public school officiais, représentatives of public interest groups, and activist parents met under the auspices of Cornell University to explore the rôle of public access (influence) on collective bargaining in public schools. The resuit of this symposium is detailed in a short volume of papers and discussion that présents us with little hard data although much food for thought especially for those of us in Québec who hâve had the chance to ex-périence a décade and one half of public sec-tor negotiations in éducation where the con-cept of "citizen be damned" is the order of the day. Behind such a heady encounter was the growing albeit begrudged acknowledgement that a trend towards direct citizen involve-ment was becoming a fact of life in the United States and that this was to hâve, in both the short and long run, an influence on the established way of seeing and doing things in labor relations. As a parent was to déclare at this gathering: "there is increasing évidence that the présent collective bargain-ing process in public éducation serves only to protect the interests of the two groups who now monopolize the power in public school Systems, the teachers' unions and the school officiais. Unfortunately, neither group has the students' needs as their primary interest" (p. 87). Quite a serious indictment, yet one that expresses the increased frustration of parents before the growing power of teacher unions, the récognition that boards of éduca-tion and elected officiais don't necessarily ad-dress themselves to the requirements of their constituents, and that American public édu-cation, on the whole, is too costly and is not doing its job. The paliatives proposed at the confér-ence went from sunshine bargaining, to par-ents' union, to public référendum, to outright union-busting in order to ensure that educa-tional policy décision making not become part of the collective bargaining process. The outcome of the discussions were to be expect-ed. Virtually ail of the proposais received the polite but far from unqualified and enthusi-astic support of the participants from the "management" corner and from the "union" side there was open and concerted disdain: the former not really wanting to an-tagonize its taxpaying public, the latter refus-ing to reduce its armament now that it is in a power position. A sophisticated «dialogue de sourds» but in the light of the Proposition 13 movement now gaining impetus throughout the United States, abetted by school âge pop-ulation décline and a badly fluctuating econo-my, there is no doubt that the American public will make itself heard and felt. Across the border we can only watch with fascination and with the knowledge that as usual — ten to twenty years later — we will re-invent the wheel. The same Québec gov-ernment that placed the Montréal Catholic School Commission under trusteeship to for-ce through a collective agreement that accen-tuâtes the érosion of quality éducation for the short-term expediency of job security, is the government that set into motion, by the pas-sage of Law 30 (June 22, 1979), a forum whereby parents will hâve a direct say in what takes place in the day-to-day life of the neigh-borhood school. Politically you can get away with ail sorts of administrative shenanigans. Beware, however, of abusing a grass-roots electorate that has been sensitized to an issue. Parents who will accept the government challenge of taking their childrens' éducation at heart by becoming involved with their local schools will soon recognize the games being played and the high stakes being lost. A coun-terforce is in the making. Perhaps Public Ac-cess should be included as a part of a suggest-ed reading list made available to ail of thèse concerned citizens! André E.
