The article deals with difficulties in selling agricultural real estate in bankruptcy and restructuring proceedings. The aim of the research is, inter alia, the clarification of the consequences of applying the provisions of the act on shaping the agricultural system to the sale of agricultural real estate in bankruptcy proceedings. Restrictions on the turnover of agricultural real estate lead to an imbalance between farmers’ creditors and farmers. The author indicates the effects of privileging the position of indebted farmers and the directions of changes in legal regulations that would improve the situation of creditors.Tekst dotyczy trudności w zbywaniu nieruchomości rolnych w postępowaniach upadłościowych i restrukturyzacyjnych. Celem artykułu jest m.in. wyjaśnienie, jakie konsekwencje ma stosowanie przy sprzedaży nieruchomości rolnych w postępowaniach upadłościowych – przepisów ustawy o kształtowaniu ustroju rolnego. Ograniczenia w obrocie nieruchomościami rolnymi prowadzą do zakłócenia równowagi pomiędzy wierzycielami rolników a rolnikami.
