Abstract
Yüksek Lisans TeziKooperatif ortaklığı, bireylerin bir araya gelerek oluşturduğu, kâr amacı gütmeyen ve ortakların ekonomik güçlerini birleştirerek onları güçlendirmeyi amaçlayan bir topluluktur. Tez çalışmamızda, kooperatif ortaklıkların İslam hukuku akitleri arasındaki yeri belirlenmiş, kuruluş ve geçerlilik şartları açısından bir değerlendirme yapılmış ve kooperatif ortaklık unsurlarının fıkhi analizi gerçekleştirilmiştir. Çalışmamız, giriş ve sonuç bölümleri dahil olmak üzere beş bölümden oluşmaktadır. Giriş bölümünde konunun önemi ve çalışmanın sınırları, amacı ve yöntemi ile kaynaklarına dair bilgilere yer verilmiştir. Birinci bölümde kooperatif kavramı, temel özellikleri ile dünya ve Türkiye'deki tarihi gelişimi ele alınmıştır. İkinci bölümde, kooperatif ortaklıkların kuruluş süreçleri, kooperatif şirketin kuruluş aşamasında hazırlanması ve imzalanması gereken ana sözleşme hükümleri ile ana sözleşme değişiklikleri incelenmiştir. Ayrıca, kooperatif ortaklık niteliğinin kazanılması ve kaybedilmesi gibi ortaklık işlemleri de açıklanmıştır. Üçüncü bölümde ise kooperatif ortaklıkların İslam hukuku çerçevesinde ne tür bir akit olduğu, kurulma ve işleyiş aşamasında karşılaşılan hataların tespit edilmesine ve bu hataların alternatif yöntemlerle nasıl düzeltileceğine dair bir inceleme gerçekleştirilmiştir.A cooperative partnership is a non-profit community formed by individuals coming together and aims to strengthen the partners by combining their economic powers. In our thesis study, the place of cooperative partnerships among Islamic law contracts was determined, an evaluation was made in terms of their establishment and validity conditions, and a fiqh analysis of the elements of the cooperative partnership was carried out. Our study consists of five chapters, including introduction and conclusion sections. The introduction section includes information about the importance and scope of the subject, its purpose and method, and sources. In the first part, the characteristics of the protocol, its basic features and its historical development in the world and in Turkey are discussed. In the second part, the establishment parts of the cooperative partnerships are given, along with the approval of the articles of association that must be prepared and signed during the establishment of the cooperative company. Additionally, partnership transactions such as acquisition and loss of cooperative partnerships were also disclosed. In the third chapter, an examination was carried out on what kind of contract cooperation partnerships are within the framework of Islamic law, details of errors in the establishment and operation stages, and how these errors can be protected as an alternative
