Litigância climática no Supremo Tribunal Federal: controle judicial da omissão governamental. Estudo de caso: ADPF 708 - DF (Fundo Clima)

Abstract

O artigo se enquadra no campo de pesquisa da litigância climática, olhando especificamente para a Arguição de Descumprimento de Preceito Fundamental (ADPF) 708 – DF, que tratou da alegada inoperância do Fundo Nacional para Mudança do Clima ou “Fundo Clima”. O objetivo do presente estudo é identificar se houve interferência do Supremo Tribunal Federal em matéria de política pública climática, considerando o objeto da ação estudada e o princípio de separação de poderes dentro da litigância climática. A abordagem adotada é a metodologia de estudo de caso, usando como fontes o julgado da ADPF 708-DF e a literatura científica temática. Conclui-se que houve interferência legítima e necessária do Judiciário, cuja finalidade foi restaurar a legalidade e assegurar a efetividade de políticas climáticas já previstas, reafirmando o papel do Poder Judiciário na proteção de direitos fundamentais em contextos de litigância climáticaThe article falls within the research field of climate litigation, looking specifically at the Claim of Non-compliance with Fundamental Precept (ADPF) 708 - DF, which dealt with the alleged inoperability of the National Fund for Climate Change or “Climate Fund”. The aim of this study is to identify whether there has been interference by the Federal Supreme Court in matters of public climate policy, considering the subject of the action studied and the principle of separation of powers within climate litigation. The approach adopted is the case study methodology, using the ADPF 708-DF judgment and the thematic scientific literature as sources. It is concluded that there was a legitimate and necessary interference by the Judiciary, whose purpose was to restore legality and ensure the effectiveness of already established climate policies, reaffirming the role of the Judiciary in the protection of fundamental rights in the context of climate litigatio
