The purpose of this article is to present the issue of financial liability of the spouses in the event of one of them going into personal bankruptcy. The article analyses the situation of the bankrupt debtor\u27s spouse. The legal (material and legal) situation of the creditor in the context of the assertion of a claim against the bankrupt debtor who is a spouse will also be subject to assessment. The paper will enable to answer the question whether, in the event of the liquidation of joint property of the spouses, property protection of the bankrupt debtor\u27s spouse is sufficient and whether the family\u27s livelihood interests are sufficiently protected under current bankruptcy law.Niniejszy artykuł ma na celu przedstawienie problematyki odpowiedzialności majątkowej małżonków w sytuacji, gdy sąd ogłosi upadłość jednego z nich. Analizie zostanie poddana sytuacja małżonka upadłego dłużnika, jak również sytuacja materialno-prawna wierzyciela w kontekście dochodzenia wierzytelności od upadłego dłużnika będącego małżonkiem.Niniejsza praca pozwoli odpowiedzieć na pytania czy ochrona majątkowa małżonka upadłego dłużnika, w przypadku likwidacji majątku wspólnego małżonków, jest wystarczająca i czy interesy bytowe rodziny na gruncie obecnie obowiązującego prawa upadłościowego są dostatecznie chronione
