Cooperação regulatória entre as autoridades antitrustes e agências reguladoras: análise empírica e institucional do Conselho Administrativo de Defesa Econômica

Abstract

This work aims to analyze, from an empirical point of view, the functioning of the cooperation mechanisms adopted by the Brazilian Administrative Council for Economic Defense (Cade) and federal regulatory agencies. To this end, it adopts an empirical and qualitative approach methodology, based on data collection, processing and analysis techniques, through the analysis of documents available on the Internet, requests for information via the Brazilian Access to Information Law and the carrying out of semi-structured interviews with Cade’s technical staff. Para tanto, adota uma metodologia de abordagem empírica e de caráter qualitativo, com base em técnicas de coleta, tratamento e análise de dados, por meio da análise de documentos disponíveis na internet, de pedidos de informações via Lei de Acesso à Informação e da realização de entrevistas semiestruturadas junto ao quadro técnico do Cade. A hipótese é a de que os mecanismos, ainda que sejam adotados, demandam aperfeiçoamento/revisão, de maneira a tornar mais eficaz a cooperação entre os órgãos
