Abstract

Стаття присвячена аналізу історіографічного аспекту теми «Майново-правовий стан литовських жінок у сім’ї та суспільстві». На думку автора, часто в історичній літературі перебільшувалася неправоздатність жінок через те, що спостерігалася невідповідність та протиріччя у правовому полі, та її реалізації на практиці. Насправді Литовські Статути трактують жінку та всі її права й обов’язки, виходячи із традиційного патріархального погляду. Однак багато джерел, з одного боку, свідчать про незалежність та невідому до того часу свободу литовських шляхтянок у XVI-XVII століттях, їхню високу соціальну активність. Основи рівності майнових прав жінок та чоловіків у Литві були законодавчо закріплені у привілеях, судебниках (1387, 1413, 1434, 1468, 1492) та Литовських Статутах (1529, 1566, 1588). Право на спадкоємство землі було основою «вольностей» жінки Литви, особливо вдів. У Молдові ситуація жінок (вищих соціальних прошарків) була аналогічною. Молдованки були повноправними власниками свого рухомого та нерухомого майна, самі ним розпоряджалися, продавали та купували та т.і. Навіть після отримання посагу молдовські жінки нарівні з братами брали участь у розподілі майна, що залишили батьки (сінісфора). Внаслідок своєї економічної самостійності вони мали високу соціальну активність та економічну незалежність (The work is dedicated to the analysis of the historiography aspect of the juridical statute and the ownership rights of the Lithuanian women in the family and society. According to the author’s opinion, historic literature often exaggerated women’s legal incapacity because discrepancies and contradictions in the juridical field and their putting into practice were observed. In reality, women had access to many property rights. In particular, the Lithuanian Statutes treat women and all her rights and obligations based on the traditional patriarchal point of view. In Moldova, women’s situation (of the higher social strata) was analogous. The Moldavian women were rightful owners of their mobile and immobile properties – they managed them, sold and bought them etc. according to their wish. Even after receiving the dowry, the Moldavian women took part, along with their brothers, in sharing the property that was inherited from their parents (sinisphora). Their economic independence allowed them to lead an active social life and to be economically self-sufficient. Still, on the other side, there is a huge number of sources witnessing the independence and the unprecedented freedom of the Lithuanian women in the 16 th – 17 centuries, and their high social activeness. The basis of equality of rights between men and women in Lithuania was consolidated by law and formalized in privileges, sudebniks (1387, 1413, 1434, 1468, 1492) and the Lithuanian Statutes (1529, 1566, 1588).
