La presente investigación tiene como objetivo analizar la figura de los derechos bioculturales desde sus diferentes perspectivas, tanto teóricas como jurisprudenciales, así como la estrecha relación que existen entre estos como nueva tendencia y los derechos de las mujeres indígenas que forman parte de las diferentes comunidades. Es por ello que el artículo, aborda una perspectiva con enfoque de género, en la que se cuestiona que este tipo de nuevos derechos a pesar de la forma como nacen, también tiene abordar de manera precisa la protección de las mujeres. De forma que se tiene como pregunta problema: ¿Cuál es la relación que existe entre los derechos bioculturales y el enfoque de genero respecto de las mujeres de las comunidades y pueblos indígenas en el territorio del Estado colombiano? la cual permio tener como principal resultado de investigación tres aspectos: i) que los derechos bioculturales surgen como respuesta a un cambio de perspectiva obligatorio para el ser humano, ii) la violencia es sin excepción un enserio presente en estas comunidades y iii) los derechos bioculturales si deben presentar un enfoque de genero para la protección de las mujeres. De manera que como conclusiones, se tiene que estos sujetos son en esencia quienes protegen de los ecosistemas y como tal el Estado y sus mismas comunidades deben entrar a salvaguardarles sus derechos no por el hecho de ser mujeres sino por su condición de ser humano que requiere de una vida libre de violencia.Universidad Libre Seccional Socorro -Facultad de Derecho Ciencias Políticas y Sociales - DerechoThe objective of this research is to analyze the figure of biocultural rights from their different perspectives, both theoretical and jurisprudential, as well as the close relationship that exists between these as a new trend and the rights of indigenous women who are part of the different communities. That is why the article addresses a perspective with a gender focus, in which it is questioned that these types of new rights, despite the way they are born, also have to precisely address the protection of women. So the problem question is: What is the relationship that exists between biocultural rights and the gender approach with respect to women from indigenous communities and peoples in the territory of the Colombian State? which allowed us to have three aspects as the main research result: i) that biocultural rights arise in response to a change of perspective that is mandatory for human beings, ii) violence is, without exception, seriously present in these communities and iii) the rights biocultural if they must present a gender approach for the protection of women. So as conclusions, we have that these subjects are essentially the ones who protect the ecosystems and as such the State and their communities must come to safeguard their rights not because they are women but because of their condition as human beings, which requires of a life free of violence
