This article examines how climate litigation can promote climate justice and democracy, and through these instruments mitigate and repair anthropogenic climate damage and disasters. Using the hypothetical-deductive methodology, the study asks the following question: can climate litigation actions serve as an instrument of effectiveness and promotion of climate justice and democracy for a new global governance of a transversal order? To prove the research problem, it analyzes data and specific cases to test these hypotheses. The results suggest that the proposed instruments of a transversal order guarantee a new climate governance and can be a powerful tool to hold governments and corporations accountable for damages, promoting a more just and effective environmental GovernanceEste artigo examina como a litigância climática pode promover a justiça e democracia climática, e, através destes instrumentos mitigar e reparar danos e desastres climáticos antropogênicos. Utilizando a metodologia hipotético-dedutivo, o estudo formula a seguinte pergunta podem as ações de litigância climática servirem de instrumento de eficácia e promoção da justiça e democracia climática para uma nova governança global de ordem transversal? Para comprovar o problema de pesquisa analisa dados e casos específicos para testar essas hipóteses. Os resultados sugerem que os instrumentos propostos de ordem transversal garantem uma nova governança pelo clima e podem ser uma ferramenta poderosa para responsabilizar por danos governos e corporações, promovendo uma governança ambiental mais justa e efetiva
