66 p.En esta investigación se abordan las problemáticas en la regulación de la
donación de órganos en la Ley Nº 19.451, y su futura modificación por el
anteproyecto que consta en boletín Nº 4.999-11.
El primer capítulo desarrollan los antecedentes generales del trasplante
de órganos, tanto a nivel extranjero como nacional, y las características que
reviste la Ley 19.451.
El segundo capítulo aborda el conflicto entre el derecho a disponer del
propio cuerpo y el derecho a la integridad física de las personas, y la lícitud del
consentimiento en la donación inter vivos.
En el tercer capítulo se desarrollan las problemáticas en la donación post
morten, principalmente en relación al criterio de muerte cerebral, los derechos
que se generan respecto del cadáver, y la viabilidad del establecimiento en Chile
de la donación presunta, en relación con los resultados del modelo español y
argentino.
ABSTRACT:
This research addresses the issues in the regulation of organ donation in
Law No. 19,451, and its future amendments to the bill that stated in Bulletin No.
4.999-11.
The first chapter develops the general background of organ transplants,
both foreign and domestic, and features 19,451 lining the Act.
The second chapter addresses the conflict between the right to dispose of
the body and the right to physical integrity of individuals, and the legality of
consent to donation inter vivos.
The third chapter develops the issues at post mortem donation,
particularly in relation to the criterion of brain death, the rights that are generated
on corpse, and the feasibility of the establishment in Chile of the alleged donation
in conjunction with the results of Spanish and Argentine mode
