Abstract
Ever increased use of the PC has engendered a series of issues in commercial and civil matters, in general, because many legal provisions imply the existence of writs, of copies signed and authenticated. It is undoubtedly obvious the practical use of drawing up pre-conflict writs, fact which reflects the truth, to a great extent, being drawn up before the conflict between the subjects of the legal report under judgment might arise. Given the major importance of the evidence in clarifying the factual data, the law regulates in detail the procedure of managing the evidence. This represents a guarantee of the right to parties ‘defense.
