“PrIVACy“被国内学界通译为“隐私“,这是对异质文化的误读、制度背景的曲解。《世界人权宣言》官方文本上“私生活“的表述提供了质疑“隐私“说的基础。英语、法语、意大利语和德语上对应词汇的语意和法律体系中的权利定位的考察印证了“私生活“说的合理性。笔者建议使用“私生活“作为“PrIVACy“的对应概念。"Privacy" is translated into "Yin Si" by the domestic jurisprudents,which misreads different culture and misconstrues different institutional background.The expression of "Si Sheng Huo" which is written in the official Chinese version of "The Universal Declaration of Human Rights" offers the foundation of criticizing "Yin Si".This article explores the meaning of the corresponding concept in English,French,Italian as well as German,and observes the orientation of "Right of Privacy" in legal system,which confirms the rationality of "Si Sheng Huo".The author suggests that we should use "Si Sheng Huo" as the corresponding concept of "Privacy".王宽诚教育基金会的资
