On Statutory Defects of and Advice for the Legislation Related to the No Claim for the Goods at the Port of Destination

Abstract

在海事审判实践中,因目的港无人提货而引发的纠纷,是当前不断增长的海上货物运输合同案件的一类。而我国解决此类纠纷的法律依据不够充分,有限的法律法规条文不够严谨,既互有矛盾冲突,又与实践操作的可行性脱节。为了更好地维护目的港无人提货的最大受害者承运人的合法权益,本文从承运人寻求法律救济时陷入的困境入手,结合我国《海商法》、《合同法》的相关规定以及有关国际公约、英美国内法,探讨了目的港无人提货的几个主要问题,提出笔者的一些浅薄观点。 全文共分四章。第一章概述了目的港无人提货的原因,并通过比较《海商法》和《合同法》的规定,明确了目的港无人提货的两大表现形式:收货人不明、收货人无正当理由拒绝提货;第二...In the admiralty judicial practice in China, disputes arising from the fact that no person takes delivery of the goods at the port of destination have been increasing in the recent years.
