Thought On Improving and Promoting the Group Contract System ——Base on the Survey of the Operational Status of Group Contract System in Shantou

Abstract

集体合同制度是调整劳动关系、化解劳资矛盾、解决劳动争议的重要制度,已被市场经济发达国家一百多年的历史所证实。我国的集体合同制度刚刚起步,远没有发挥其调整劳动关系的重要作用。在社会主义市场经济体制逐步形成、现代企业制度正在建立的社会背景下,中国的劳动关系发生巨大变化,劳动争议急剧上升,新形势给劳动关系的调整制度提出了挑战。本文试图从集体合同制度的基本法理出发,以笔者所在市的集体合同制度运行状况的调查为分析中心,借以探究我国集体合同不容乐观的现状;从对集体合同的立法、工会的独立性、集体谈判、多层级集体合同体系的建立等方面,分析集体合同制度存在的问题及原因;从经济体制转变带来的劳动关系主体利益变化、...The group contract system is a very important system in adjusting labor relations, solving labor contradiction and resolving labor disputes.
