内容摘要民事再审制度是我国民事诉讼制度的重要组成部分，由于我国民事再审程序的立法上存在缺陷，致使司法实践中出现诸多问题，未能实现立法意图，对于民事再审制度的研究成为我国学术界和司法界的热点。本文在对此进行理论探讨和实践评析的基础上，提出再审程序重构若干设想。文章除引言和结束语之外，共分五章第一章对民事再审程序进行概述，首先阐述了民事再审程序与审判监督程序、申请再审与申诉之间的关系；然后简要介绍我国现行民事再审程序的基本框架；最后通过近年来我国民事再审案件的基本情况分析我国现行民事再审程序存在问题并进行反思。第二章简要介绍现代各国民事再审程序的立法状况。通过对大陆法系代表国家法国、德国和日本及英...Abstract Civil retrial system is an important part of Chinese civil lawsuit system.
