内容摘要 二十世纪中叶以来，非犯罪化的刑法改革思潮席卷全球，对传统刑法观念产生了巨大冲击，有力地推动了世界各国刑法的革新。非犯罪化以刑法谦抑精神为导向，以人权保障为追求目标。我国在构建和谐社会并倡导“宽严相济”刑事政策的时代背景下，合理借鉴非犯罪化的观念，对一部分轻微犯罪予以非罪化，有助于缓解我国司法机关的工作压力，节约有限的司法资源。同时，有助于推动我国刑法的现代化，促进社会和谐。因此，对我国非犯罪化的根据进行探讨，并积极尝试和构建非犯罪化的实现路径，对于非犯罪化在我国的本土化无疑具有重要的理论价值和现实意义。 文章重点在于分析非犯罪化的根据以及非犯罪化在我国的实现路径这两个方面。文章从...ABSTRACT The trend of decriminalization reformation of the criminal law has been sweeping the whole world since the middle of 20th century, which strongly stroke the traditional criminal law concept, and effectively drove the criminal law reformation all over the world. Decriminalization is based on the spirit of criminal law’s compressing and restraint, and it aims at pursuing the guarantee of human rights. Under the background of the establishment of harmonious society and the advocation of criminal policy of “Combination of Leniency and Strictness”, our country should absorb the concept of decriminalization reasoningly, and make part of mild and slight crime decriminalized, which could alleviate the working pressure of judicial organs, and save limited judicial resources. Meanwhile, it can also impel the modernization of criminal law, and promote social harmony in our country. So it is of great theoretical and practical importance to the localization of decriminalization in our country to discuss the bases of decriminalization and attempt to design the approach of decriminalization actively. The thesis focuses on analyzing the bases of decriminalization and its realization approach in our country. It discusses the realization of decriminalization in our country from both legislation and fact aspects. The content of the thesis is as follows: Preface: It mainly accounts for the meaning of decriminalization in our country and the purpose of the thesis’ writing. Chapter one: The summarization of decriminalization. It includes the definition, classification, and the historical background of decriminalization, and analyzes the differences between decriminalization and depenalization, non-institution，slight punishment and non-criminalization. Chapter two: The bases of decriminalization in China. It also discusses the internal bases of decriminalization, including social harmfulness, bottommost morality of criminal law, and necessity and validity of criminal punishment. 意大利刑法学家帕多瓦尼说：“刑法体系的发展是无止境的，人们要想保障该体系的完好性和有效性，就应该针对扩张刑法体系的定罪化作用力，保持一种非犯罪化的反作用力，把所有不再具有重大社会意义的行为放到次要位置上去。”① 非犯罪化和犯罪化恰如刑法的两个助推器，共同推进刑法的发展和完善，不可偏废任何一方。我国刑法的进步和完善当然也不可忽视非犯罪化的价值和作用。面对世界各国非犯罪化改革思潮，我们既不可视而不见，但也不能盲目追随。对非犯罪化给予理性审视和考察，努力实现非犯罪化在我国的本土化，有助于节约司法资源，推进我国刑法的现代化，促进社会和谐。  当前，我国正处于社会转型时期，犯罪态势一直持续攀升，国家有限的司法资源难以应对数量庞大的犯罪现实，如何合理有效地分流一部分刑事案件，实现轻微犯罪的非罪化，就成了摆在我国面前的一个迫切问题。因此，对非犯罪化的根据予以充分地论证和分析，对非犯罪化的实现方式进行探讨并提出具体的构建路径，对于我国非犯罪化的实现以及我国刑法的进步和完善都具有极其重要的理论价值和现实意义。 对于非犯罪化的概念，目前世界各国尚未形成一种统一的观点。非犯罪化（decriminalization）与犯罪化（criminalization ）相对, 考察外国学者对其所下的定义，主要观点有：Black 法律词典对非犯罪化解释为：通过立法使以前是犯罪的行为变成不具有犯罪性并免除其刑罚处罚。①日本刑法学者大谷实认为，所谓非犯罪化是指，将迄今为止作为犯罪加以处罚的行为不作为犯罪，停止对其处罚，因此，它包括变更从来作为犯罪科处刑罚的现状，而代之以罚款等行政措施加以处罚的情况。②法国学者马蒂认为：“非犯罪化的概念应当从 广泛的意义上来理解，它不仅包含了刑法制度的消失，而且意味着所有替代性反应的不复存在。” ③欧洲委员会出台的《非犯罪化报告》认为，非犯罪化可以通过立法活动进行，也可以经由司法机关解释立法的途径来实现，因此，非犯罪化可以被区分为“法律上的非犯罪化(de jure decriminalisation)”和“事实上的非犯罪化(de facto decriminalisation)”。“法律上的非犯罪化(de jure decriminalisation)”，是指“刑罚制度拥有的作为对特定行为的正式反应的制裁范围收缩的过程。” 亦即改变现行法律的规定，将特定行为从刑法干预范围中排除出去的立法过程。“事实上的非犯罪化(de facto decriminalisation)” ，是指“尽管刑罚制度的正式能力没有发生任何变化，但刑事司法制度对特定情况下特定行为（逐渐）减少其反应活动的现象。”④  我国学者对非犯罪化的界定有：台湾刑法学者林山田教授认为：“非犯罪化是针对现行刑事实体法所规定的犯罪行为，通过刑事实体法的修正，将其删除，使其从刑事制裁体系中除籍，而不再是刑事实体法所要加以处罚的犯罪行为；或                                                        ① Henry, Campbell Black.Black’s Law
