一直以来，遗失物拾得制度在物权法领域中的地位稍显边缘，但随着科学技术的发展，许多价值较高的动产也更加便于携带，我国遗失物返还率较低以及相关纠纷增多的现状，使得遗失物的法律规定也引起了更多关注。《物权法草案建议稿》中曾提出过拾得人的报酬请求权内容，但基于此内容与我国传统美德相悖的考虑，《物权法》最后只保留了费用请求权的内容。因此虽然《物权法》对遗失物拾得制度进行了梳理，但是其规定仍显简略，且在一些核心规定如遗失物拾得人的所有权和报酬请求权方面，其合理性仍值得推敲。而从我国目前遗失物制度的现状和国内外立法的实践来看，赋予拾得人报酬请求权是十分必要的。本文进而试图通过对国外立法经验的总结，提出我国相...In the field of property law, the system of picking up lost property has always been in the edge position.
